Holladay, dealers in snuff and tobacco, charged belore United States Com missioner Sergeeut with defrauding the Revenue Department. Kdward N. Cohu was called to the stand and testified fn substance that lie is a box-maker, and that he had an interview with Mr. llcllulay at his establishment, in Ledser place, and was nsked by him it he could fix up boxes which had contained snutf and which had been sent back. He said he wanted Dew tops on tliem.ar.d all the marks erased upon them except the Inspection, maike. Mr. Solomon was present on one occasion when witness had an intervie w with Mr. Holla day, and asked as to the price of the alterations. The boxes, to the number of one hundred and thirteen, were taken to etiop of Mr. Conn and altered according to directions. New tops were put on them, and all but the inspection marks removed. W itness was present at Mr. Jlolladay's nhoD and saw one oi the boxes opened, aud said that it contained snuff in bottles; he saw St. Louis on some of the boxes, and they had a dirty ap pearance, as it they had been shipped to distant points. A. B. Sloanaker testified that he had been in formed ot the use of boxes a secou 1 time, with, the inspection marks upoii them, and bad made, under direction of the Itevenue Department, a seizure of all the property at Air. Holiday's place, and also at the store of Messrs. Crossruan k Solomon. At the latter establishment one of the altered boxes was found. On the evening of the seizure Mr. Holladay called on the witness and said that he would do anything (to expedite the investigation ; that he was merely employed to pack the snuff; and that he was doing it for Croseman & Soloman and W. Garrett & Co. The Collector visited the storekeepers, Cross man & Solomon, and passing into the counting room, acked if any ot the Srm of (larrett & Co. was present, and an old gentleman bowed affir matively. Martin Solomon informed huu that two firms were doing business in the place, and he trusted the seizure would not atl'ect f he busi ness or credit of either; witness examined the stock and made a seizure of it; all of it was afterwards delivered except that portion which did not bear Inspection marks. At a subsequent interview between the Col lector and members of the firm of Salomon & Croseman, ho understood that Martin Solomon was a member. This, however, is denied; he 19 said to be the aeent only. After the examination ot the witnesses, the counsel Jor the defendants atgucd that there was no violation of the revenue law, as Mr. Holladay was only using boxet in which snurf bad been shipped to St. Louis, aud sent back again, and on the contents of which the tax had been paid. The United States District Attorney took a dif ferent view of the matter, aud areued that the revenue law had been violated; as to whether the testimony was sulheient to connect Mr. Solomou with the oileuse, it was lor the Com missioner to say. Mr. Sergeant bald he would examine the testi mony and give his decision to-day. Odr Firemen. The Moyamensing Hose Company hoiii-cd a sew hose carriage on Satur day.
