The copriifht of tho whole of this edition was, with the assent of Mr. Ltwrence. taken out in the name of Mrs. Cuttiarioe Wheaton, the widow ol the eminent publicist, one of whoso daugh ter was the wile of Mr. Little, of the tirni of Little, Brown A Co., ot this city, who were the publishers of this sixth, edition, as they are of Dana's edition. A second annotated edition was published by Mr. Lawrence in 1803, witn extensive notes anil nmcU other original matter, and, by his assent, copyrighted in the name ot Catherine: Wheaton, who was then living, but has since died. It als-o appears, accoidinir, to the opinion of the Chancellor, tnat Mr. Lawrence obtained lor the widow and her unmarried daughter six thousand francs from Mr. lirockhaus for tho publication of a French translation of bis notes, connected with the woric, and Mrs. Wheaton was authorized to draw lor toe same; and on tbe payment ot this draft Mrs. Wheaton agreed to make no use ol Mr. Laurence's notes in a new edition without his written concent. The draft was paid, Miss Mariha B. Wneaton receiv ing for her mother tno proceeds of the 6U00 francs about $18(M) in United Slates currency. Mrs. Wheaton died drectly thereafter, and Mis Martlin beconio her personal representa tive; and not withstanding tho many and signal acta of kindness on the part of Mr. Lawrence, shown towards the latler when living, and the mother during her wido. hood, and the chillreu during their orphanage, Miss Martha, as is now alleged, in coniunctiou with It. 11. D., etc., edited by Richard Henry Dana, Jr., L.L. D., and the copyright lor the name is entered in the name ot Mariha B. Wheaton. In this eighth edition the Chancellor any he finds that notes ot Mr. Lawrenee are published entire, with no alteration ot the original lan guage, and the authorities collected and citod or referred to are the same, as are the public documents, and letters, and documentary evi dence in short, all the work not original with Mr. Wheaton is taken bv )hii:i, as editor of the eighth edition, and the distinguished Chancellor is of the opinion that Dana's publication is an unjuBtitiable violution of Mr. Lawrence's equita ble rights, under tbe arraneeincnt niude with the widow and daughter of 1863. As additional evidence in support of tho cbarso of plagiarism brought uiMiust Mr. Dana iu this eicntb edition, KU-lia It. Potter, a law yer of Rhode Island, nli;s an affidavit, in which he makes, an extended review of the two book that by Lawience and that bv Dana and cites numerous Instances of identity aud simi larity in the complainant's book aiid tho book described iu tho bill as the defendant's book. One kind of these instances ot identity or simi larity relates to the use in Dana of the same lacts, authorities, and illustrations that are found in Laurence, in such a way that the notes iu the lornier could have been written by the use ot the latler alone, and without recurrence to any or ginuls, and without any original inde pendent investigation of the subject. ' lothcr kind consists in the tact that in Law rei 's notes the ecltor has not inserted all the que. lions and citations thkt might have been uies.led, but bus exercised judgment in the selection of some and the omission of others; and that many of the books irom which he has most irequently cited, and some piomineut treatises, have been continued and much added to since Lawrence was published in 18GH. With comparatively few exceptions, the editor of Dana ban not made any citations or quotation not to be found in Lawrence. Tlio "text" ot tho two books is also referred to. The edition in question contains nothincr but the text of Mr., Wheaton, according to nis lust revision, his uotos, and the original matter contributed by tbe editor. In the course of these searchiog examina tions, typographical and clerical errors and typographical and clerical peculiarities are found in Dana which correspoua entirely with those iu Lawrence. Among them may be men tioned the following: Xbe Queen's 'speech of Febiuary, 1802, is quoted in Lawrence, 158, in Daua 127 each prints the phrases "nariuus foreigners." The speech is given in Annual ltegihter, 18(52, p. f, and does not contain the word "various." Tbe Swiss circular of April 9 is cited by Lawrence, 706, Dana 614, both citing Almaiuivh tie Gotha, 1861, us autnoiity. Upon reierenco to page CO of that book ii is found tnat ihe true daie is April 11. A passaire from the Berlin Decree is quoted, with murks ot quotation. The quotation in both is in English, and the reference in both is to the volume and page of Martens, where the original French text is touud. The translation ih identical in both. A large number ol other t,cculiaritie, as well as unintelligible and meaningless quotations, are found in Dana corresponding with Lawrenee. All good lawjers know that Mr. Lawrenee is very accuiate in citing the titles ot books iu fcucu a manner as to ideutify the particular votumo Ut-Cd, In the title given by Mr. Dana to a p reat many cases tbe volume is not identi fied, or tho wrong book and volume is noi iden tified; and where Mr. Larenee does not quote verbatim Irom original documents, lie has gene tally u.ed the original phraseology and tec bin -nal exprcsions. It is alleged that where Mr. Dana's notes con tain the subsUiiice of the matter so given by Mr. Lawrence, the language is in many instances changed. These instances are Of such a nature that it would be unnatural lor auy one, and almost impossible for any person who was accu rate, or who was conversant with the subject and the literature relating to it, to make them ii he wrote wlm the original books quoted in these notes be I ore him. A schedule of these instances is referred to. A compaiison ot the citations of Dana with the Revue Etrannere et Francaise, a French periodical, to which Mr. Wheaton was a contributor, developes tho tact that Dana makes no distinction in his citations; but tbe volumes ot the first of this work are cited under tbe name ot the second, und vice rmia. The citations in Dana irom Martens' "KeouclPof eight volumes, and supplement to Martens' "Recueil," four volumes, are alleged to be incorrect, and tbe volume, or "part," cited is not given, whereas this distinction is iuvariably made by Mr. Wheaton, by Mr. Law .1 bv all the other modern writers.
