To construe this language tto as to require their personal intervention would defeat the oounty intanded lor them until they should become sui juris. Wherever the right to be inserted or recovered does not trom its very nature require the ac tual personal intervention ot tho claimant, the rirrht oi substitution necessarily prevail. Tins rl.uht is valuable, and oltcu absolutely necessary, and it seems to mo that its, denial in tho matter of claims tor bounties would in many cases totally detent the clainiunt, aud in ui-nilt ail cases lead to preat expense and delay. Tne Dountv given by this act is not given to each soldier by nane in tne way of au abso lute ni:t. where nothinp is to be done hut only to claim and receive it, but th" persons who claim n.ust prove their claims, aud must exactly contorin to various tonus and regulations belore they can toucn the money. Tho pursuit ot a right to bounty is well culled a claim, aud mhzht as well be called a suit. It is a rlcht that is not acknowledged, asoi course itniust be established toy proof made according: to certain forms, and nuully be adjudicated and allowed or rejected. It is very analogous to a claim made in a court of law. especially to that class ot suns which are er parte, and in general may just as much lequire the intervention of an attorney. It is certain that if this net should be oon-ttriicd so as to require every soldier and every child of a soldier to make tne claim in person and collect the nionev in persou, comparatively lew coidd avail themselves of tho bounty of the Govern ment. I am, therefore, of opinion that jou have no local authority to ex clude authorized attorneys and agents from col . lectins bountie.-. and that in the presentation and pavmeut of claims The claimant may act by at torney. I see nothlntr in I lie rules and regula tions ptescribed for the payment of these boun ties which excludes the intervention of attor neys; they aro silent on the subject. The form of atiidav'it prescribed to be made by the soldier and referred to in the rules coutaius the clause: "Aid he desires all communications concerning this claim to be sent to him." This is no part oi the ORth, but only a request for the conve nience ol the soldier lii the matter of correspon dence, aud is subject to change by another suo sequent request, even as to correspondence, and is not at all inconsistent with a special delega tion to an attorney of power to present and collect the claims.
