The Alexandria Habeas Corpus Case.
OPINION OF ATTORNEY-GENERAL SPEED.
Considerable attention has been Riven to the
decision of Judge Underwood, in Alexandria,
Va., lately, in tha cise ot Thomas Javins,
fetitioner ior a wilt of liabeus corpus. In May,
865, Javins assaulted a colored boy, Frank
Beall, and in the assault the boy's le was
broken. Javins wa thereupon arretted by
General Slough. In October, Beall brought an
action for damages in the Provost Court, Capt.un
P. R. HHmbrick, Judse, and recovered $500
damages, the Court ordering Javins to be im
prisoned till the dunnages were paid. This de
cision was appioved by General Augur, and a
few days since was carried into execution by the
arrest of Javins and his confinement in the
Slave Pen, in default ot payment oe the judg
ment. He then petitioned the United States
District Court tor a writ of habeas coipus, to
discharge him from tbis confinement.
The writ was served on Captain Hanibrick,
who made return thereon that he held the pri
soner by authority of the President of tho United
States. The prisoner's counsel relied upon, first,
a loi mer conviction by General felough ; secondly,
want of jurisdiction in the Provost Court over a
case of this nature. The respondent's counsel
argued that the return of Captain Hambnck.
was conclusive, and upon it the prisoner must
be remanded to custody; and secondly, that, if
the return did not preclude the Court from
going further, the Provost Court had jurisdic
tion, being the Court designated for the trial of
these cases, by the Preedmen's Bureau, in ac
cordance with the rules and regulations of. the
Bureau approved by tbe President. Judge Un
derwood decided that the writ of habeas corpus
was not restored by the recent proclamation o
President Johnson, and that tne return of Cap
tain Hambrick that he held the prisoner by
authority of the President was conclusive, and
the Court could not go behind it. The prisoner
was accordingly remanded to coudnement under
the sentence ol the Provost Court.
We learn that tre Attorney-General has given
an opinion adverse to the decision of Judge
Underwood, and that an order has been issued
for the release of the prisoner on the writ.

va. Un Thursday evening ot last week Mrs.
Drummond, wite ot Captain John Drummond,
resident of Accomac county, near Pongoteague,
was mont brutally murdered by a negro, who
was recently in tbe army. Tho Newtown Recvrd
eavs:
"He a'so attempted the murder of a oolored woman
at the same time, iiis purpose was roobery. tie
asked Mrs. Drummond for some money supposed to
be in tbe bouse which she relused to give him,
wbert upon he procured an axe aud burst her skull
open and dragged ner to the stables, tie then de
li anded of the colored woman that she should say
that the horse kicked her mistress. Sue refu'od to
tell the falsehood, and he then struck her with tbe
axe in tbe same manner, and left her for dead. Ihe
colored woman, thouirh dangerously wounded, re
vived suflicientiy to relate the above foots, and wita
strict attention being paid to her case may eventually
recover. The citizens of Fonnoteiiirue went In
search of the author of tbe fiendish act, and capturing
mm, at once hung Dim to a iimo oi a tree."
