Here, however, in a British colony, is the case
Of a band of robbers, organized on British terri
tory, for purposes of common robbery in the
bordering towns of tho United States. "The evi
dence against them is indisputable. There is
rot a fchadow of a defense to oiler on tho piinl
of the commission of the crimu alleged. But itio
plea is, that the robbery was a legitimate act of
belligerency, and that a commission should be
