CIIAX.tN IX THE PRIZE LAW.
from ia Timet.
.. Op looking over the act In relation to prize pro
ccedli gf, which w.is pa sed nt tbe close of tho
. recent sesidon of Congress, wo notice several
' changes made by it in the law of prize, whi h
will be of interest and import mcd to oar navy.
The law in rulatiouto Joint dipt ires, for Instance,
la mod: Hi d in this way : Tbe law of July 17,
1862, ptovie'ed that "when one or more vessels of
tbe navy shall be within signul distance of an
otl er making a prize, all shall share in thepii.e."
The piesint law provides that "all vessels of tho
caw wiihln s gual distance of the vessel or vcs-cls
tnak'tiK the capture, under such circuinscau i s
nd in si rh condition us to be a 'lu to nnder
lhit je aid, it rcipiueii, shall shire In the prl.e."
There may be a ipiestiou, perhaps, whether the
fomn r provision is so lucimsi teut with this m to
be n pi aled, and if not, whether a vessel within
' ligual Oistiice would n 't oe entitled to share,
kllbong noi able to reader any ell'.ctive a d in
the cai tore. Tho new Imitation w is d m'ltlo.s
intended to be in a lu penerttl, and if it applies. It
leaves i pen f t nmnv cases a very in erestlnji
discussion as to what shall constitute thj pjivcr
to five i llectuui aid.
Another change Is In relation to captures mado
tiy vi ssels rot lo the I uvy The previous state of
the law prohibited utiv but vessels of the n ivy
from sharing in piie property, utid sevoral cases
have arisen where captures have been made by
other vessels and fhe proceeds of the prises ap
priaied by tho Government. We call -d atten
tion to this state of tho law, and urged Congress
to modify it. Congress has done so, in this act,
providing that where captures are mado by res
ksh not ol the navy, "iivuo ahull be entitled to
share except the vessel or vessels making tho
capture."
Tbo proceeds of a prize so captured are to be
divined between tbe owners of the capturing ves
sels and the ship's company, equally, unless
otherwise agreed in writing. The half which
goes to the ship's company is to be distributed
according to their respective rates of pay on
board, making tbe rule, as wo understand it,
slightly dutereut on board such vessels front
what it is ou vessels of the navy, whore the com
mander of the ship has three-twentieths, and the
reft is divided according to the rates of pay on
board.
A difference ia alto made by this law as to thu
Share or prfe-money to the ottk-er commanding
fleet or squadron. Now, if a division of a Heat
ir squadron ia ordered to detached duty nnder
tie command of an otneer, and makes capture,
the twentieth of ths priie-mouey, which formerly
went to the commander of the licet, is divided
between him and tbe tthcei in command of the
division. , A

An enthusiastic Dane, writing from Copenha
gen to the London Alhrnu urn, states that Don
mark, always a small kingdom, hns been so
frequently attacked, that Its preservation "would
lead to tho belief in a higher will and necessity
protecting our national existence. Like oar beau-
' tifnl green islands 'floating on tho waves,' wo
j have been threatened for centuries by hostile
; elements, and in great storms wc have been
I overrun; but the opposing foo has novcr been
' able to do more than leave bis froth on our
chores." He then proceods to give this Instance
of an invasion as far back as 1110 ;
"The weak, wretched Government of Christo
pher the Second had brought the country not
only to tho brink, but to the very depth of the
obyss. German princes, among 'whom figured
tspecia'ly the Holsteln Count, Gucrt the llald
(by Gei mans called Count Gerhard tho Great),
lind divided the whole country among them
selves, so as to leave to the King only tho small
town of Skamlcnhorg, in Jutland, and the
iBland of I.olland. Wherever tho Danes rose to
recover their independence, they were merci
lessly tininpled down. Of three royal rriuecs,
one was killed in the battle of I.obede,
another was made prisoner at Tap-lledc, and
a third b.'cnme an exile. All hopes of future
recovery seemed extinguished, when a Danish
knight, the Jutlander Nieis Kbbusen, meeting
with Count Gbcrt, upbraided kiiu with his in jus
lice and cruelty. The haughty Count threatened
Niels Kliliesen that he would have him hanged
on the highest tree; tbe Danl-h knight then,
loudly proclaiming deadly feud between hiuiielf
and the Count, made his escape. Accoiduig to
the rules id' chivalry, tiny were now at each
other's mercy wherever Ihcy should meet.
"Count Gbcrt made his advanco into Jutland
sacking, burning, and murdering on all sides. Ho
took the towv. of Kanders, nnd was lying there
with four thousand men, when Niels Knbcsen,
accompanied by only sixty followers, rc-olved to
n truck him. Ah his little band, approaching in
tno ac.oi ot tno nignt, came to a small river,
young Svend, Niels Kbhesen's page, refused to
pass the bridge, and, without a word of com
plaint, the knight left him there. Kiiteriug Han
dera by surprise, he stormed tho house wherj
tie Count had taken up his abode, and, the
Count, scicd in bis bed, was bibetded, bis
bedstead serving as a block. Meanwhile, the
alarm sounded in the town, and Niels
Kbbescn was forced to retire before the
overwhelming numbers of the enemy. On
agnin reaching tho other side of tho rivor,
ho found young Svend, his pago, who, having
taken out tho nails from the bridge, now threw
it down, and thereby put a stop to tho pursuit,
and (aved his master. Once during the period of
the fend, i'is said that Niels K.bbesen met In a
I wood a coke-burner's widow, who bad but two
small loaves left for hersolf and bor children ;
but on recognizing Niels libbescn, tho banc of
the Iluld Count, she gladly offered to share the
bread with bim, and she bles-cd him as tho
savior of iho country. Hut the knight declined
to accept her oiler, nnd, promising her bettor
days for tho women and children of Denmark, ho
rode on to meet his fate death ou tho battle
field !"
