Congress has done so, in this act, providing that where captures are mado by res ksh not ol the navy, "iivuo ahull be entitled to share except the vessel or vessels making tho capture." Tbo proceeds of a prize so captured are to be divined between tbe owners of the capturing ves sels and the ship's company, equally, unless otherwise agreed in writing.
