THURSDAY EVENING, DECEMBER 5.
By an Americau captain from Cap: Fran
jais, we are told, that Lord Balcarras has
forbidden the entry at and departure from
Touffaint's Dominions, under and
Spanish colours, as a degradation of the
Britifli Flag. This is believed to be the
ground of the report propagated at the
Southward, by the member of Con^refs.
It is added, on the fame authority, that
Touffaint loses ground daily.
Previous to the late aaion, the British
and Ruffian f>rce amounted toabout 35,000
men ; that of the enemy was not more than
20 oco ; but a great part of our force was
not engaged. All the letters from thence
agree in dating, th?t a second attack wa«
expelled to take place in two or three days.
The Duke of York had a very narrow
efeape in the late engagement in Holland
as his royal highness was encouraging and
leading on his brave troops, a cannon bull
parted between him and one of the guards,
but happily he received no injury from it.
Major-General Christie Barton, is ap
pointed Lt-Governor of Upper-Canada, un
der Governor-G' neral the Duke ol Kent.

Recapture oftht Hermionk frigate.
Captain Williams, just arrived from Lagui
ra, inform* us of the recapture of the Her
miotic, fo'merly Britifli frigate, and taken
by her mutinous crew about rwo years firice,
and fold to the Spaniards in Laguira. She
was cut out of Port Cabello, in a mod
gallant manner, by four boats from the
Trent British frigate, with only 120 men.
The Hermione was laying at a wharf, se
cured only by a fall, in a passage about a
pidol (hot wide, leading into the harbour,
and under the guns of a mod formiJable
cadle ; flie was complete for fca, and was
(uppofed to have on board 500,000 dollars
property. Her crew confiding of 600 men,
but were so refraftory, from a relu&ance
to go on board a fliip where such horrid
murders had been perpetrated, that 110 more
tha« 180 were doing duty at the time;
120 were in irons on board, and the remain
der were confined on (bore ; (he was at the
fame time deficient in officers. Under these
circumdanccs, with h*r head lying out
wards, and a leading wind, the detperate
attempt was made by the British boats :
they boarded her, cut her fad, killed the
captain and many of her crew, and got fafe
out, although (he was under a cadle mount
ed with 300 brass cannon, and had to pass
several inferior forts.
The astonished Spaniards declared it to
be the ail of devils, and not of men. The
Spanish captain was a brave audamableman,
and deeply regretted by his countrymen.
The Spaniardsbadexpem'ed 200,0c0 dollars
upon the Hermione : (he had 50 guns moun
ted, and was Ihortly to h<ve failed to ren
dezvous at Cuba.
NEW YORK. December 4.
The Supreme Court yesterday delivered
their fent»:nce in ihe cafe of David Frothisg
ham, previously convifted on a charge of
afperfmg the charadter of General Hamil
ton, by publishing that he had been at the
" bottom of an attempt at fupprtffing by
pecuniary means th« Aurora." He was fined
in the sum of one hundred dollars—ordered
to be imprisoned for four months, and to
give feeuriiy for his good behaviour for two
years; hi 1 felf in one thousand dollars, and
two furttics each in five hundred. One
fiirety we- arc informed is Dennis M'Gaha
gen—the other we have not learned.
