ORDINANCE

SIDEWALKS AND til" ITERS.
Section I. All pavements, side or
foot walks constructed along the streets
in front of or along the sides of all lots
within the limits of Urn Borough, shall
tie eight feet wide, including curb
stones, from the established building
line, and no steps, porch* s, verandas or
fences shall extend more than three
and a half feet from the said building
line, leaving the side walks four and a
half it> the unless otherwise
directed by special oidiuauce of the
Town Council : Provided that no hay
window or other permanent part of
any building shall extend beyond the
building line of any street, except by
special ordinance of the Town Council.
Sec. 2. All entrances from side
walks into cellars shad he closed by
trapdoors sufficiently strong to serve
as part of such side walks, and shall he
on a level with the same, excepting in
cases where such doors shall not extend
further than to a point four and a half
feet from the outside of the curbing :
Provided that all such entrances not
enclosed by trap doors as aforesaid,
shall he closed by and suffi
cient doors, or railing.
Sec. 3. Sidewalks, steps and porch
es, in alleys of twelve feet wide, shall
not extend over twenty inches into
such alleys ; in alleys of sixteen feet
wide, such sidewalks, steps and porches
9hall not extend over two feet six inch
es as aforesaid, and in alleys of eighteen
feet or more in width, such sidewalks,
steps and porches shall not extend over
three feet six inches as aforesaid. All
such sidewalks, steps and parches, as
now constructed, may remain, nut
whenever repaired or rebuilt, must tie
made to conform with the provisions
of tnis section.
Sec. 4. It shall be the duty of the
street commissioner to notify the own
er or owners, reputed owner or owners,
his, her or their agent or attorney, of
any lots of ground within the limits of
the Borough fronting orextendinealoiig
any street, to construct at the grade es
tablished by the Town Council, and of
the width established by ordinance, a
good, substantial pavement or sidewalk,
of brick, stone, concrete, or plank not
less than two inches thick ; and upon
the failure of such owner or owners,
his. her their agent or attorney, to
make such pavement or sidewalk with
in thirty days after the set vice of such
notice, it shall be the duty of the street
commissioner to make said pavement
or sidewalk of such material as herein
before specified, and report lite expen
ses so incurred to the clerk of the coun
cil. whose duty it shall bj to enter said
bill with an addition of twenty per
cent, thereto into a book to be kept for
that purpose, and to furnish the attor
ney of the Town Council with a certi
fied copy of said entry so made ; and if
the amount of said bill as rendered by
the strtet commissioner, with the
twenty per cent, added shall not be
paid within ten days after notice from
the attorney that the same has been
placed into his hands for collection,then
it shall be the duty of the said attorney
to cause the same to be entered as a
lieu against the property along which
the said pavement or sidewalk was con
structed, and collect the same as claims
are by law collected under the provis
ions of the Act of Assembly of April 3.
1851, regulating Boroughs, the sup
plements thereto.
Sec. 5. It shall be the duty of the
owner or owners of all lots within the
Borough, in front or along the side of
which pavements or sidewalks have
been constructed, to keep the same in
good repair ; and if any such owner or
owners shall neglect or tefuse for five
days after having received such notice
from the street commissioner to repair
such payement or sidewalk, it shall be
the duly of the street commissioner to
repiir the same forthwith, and return
a bill of expenses with twenty per cent,
added, to the clerk of the council, to be
collected in ttie same manner as pro
vided in section four of this ordinance :
Provided that no such repairs shall be
considered sufficient unless approved by
the street and alley committee.
Sec. G. It shall be the duty of the
street commissioner to notify any per
son or persons obstructing any street
or streets, alley or alleys, contrary to
the provisions of sections one and three
of this ordinance, to remove such ob
structions ; and in case the person or
persons so notified shall neglect or re
fuse to remove such obstructions for
twenty days after such notice, the
street commissioner shall remove the
same forthwith and return a bill of ex
penses, with twenty per cent.added, to
the clerk of the council, to be collec
ted as provided in section four of this
ordinance.
Sec. 7. It shall be ihe duty of the
street commissioner to notify theowner
or owners, his, iier or their agent or at
torney, of any lots of ground having an
entrance or entrances from the side
walk into the eellar of such premises,
to make, bui'd, or enclose the same to
conform with the provisions of section
two of this ordinance ; and in case the
person or persons so notified shall neg
lect or refuse to make, build or enclose
such entrance as aforesaid for twenty
days alter the service of such notice,
the street commissioner shall proceed
t,o do so forthwith, and return a bill of
expenses, with twenty percent, added,
to the clerk of the council, to be collec
ted in the same manner as provided in
section four of this ordinance.
Sec. 8. It shall be the duty of the
owner or owners of all land abutting,
fronting or laying along the sides of
the strpets and roads within the limits
of the Borough, upon being notified by
the street commissioner, to build foot- j
walks, pavements, gutters,culverts and
drains of the size and width establish
ed by ordinance for such walks, pave
ments, gutters, culverts and drains,and
m comformity with the survey and
grade established by authority of the
Town Council ; and if any owner or
owners shall neglect or refuse to make
or bwild such footwalks, pavements,
gutters, culverts and drains within
, twenty days after notice given him or
them, it shall be the duty of the street

commissioner to make and build such
footwalk, or walks, pavement, gutters,
cu.verts and drains, and ret urn bill of
costs witli twenty per cent, adchd
thereto, to the cleik of the council, to
lie collected as provided in section four
of this ordinance.
Sec. 9. The owner or occupants of
all properties in the buill-up portions
of the Borough, shall, within six hours
after the fall of any snow or sleet, re
move the same from their respective
sidewalks : Provided that If such
snow or sleet shall fall during the night
time the said six hours shall count
from and after six o'clock of the fol
lowing morning; and any person or per
sons who shall neglect or refuse to re
move such snow or sleet as aforesaid,
upon complaint of any citizen, shall
upon conviction before the Chief Bur
gess or any Justice of the Peace ot the
Borough, pay a fine of one dollar.
FAST DRIVING NOT TO DRIVE ON
SIDEWALKS.
Sec. 10. Itsha'l not lie lawful for any
person or persons to drive or ride any
horse,mule or other beast of draught at
adangerousrate of speed on or over any
of thH streets of the built-up portions of
the Borough, or todrive, ride or lead any
such beast of burden, or to drive any
Vehicle on or across any of the pive
ments or sidewalks of the Borough, ex
cepting such vehicles as are propelled
by hand : Provided that it shall not he
law ful to propel any hyetele or trycicle,
or to coast with sleighs or sleds of any
kind,on the sidewalks or over the cross
ings within the limits of the Borough ;
and any person or persons convicted of
violating any of the provisions of this
section before the Chief Bnrgess.or any
Justice of the Peace of the Borough,
shall he fined not less than one, nor
more than ten dollars, or undergo an
imprisonment in the Borough lock-up
for a period of not less than one, nor
more ii.an twentv-four hours, at the
discretion ot the Ctiief Burgess or Jus
tice of the Peace before whom convict
ed ; Provided that this section shall
not apply to persons passing to and
from their own premises.
VEHICLES NOT TO STOP ON CROSSINGS.
Sec. 11. No vehicle of any kind
shall he stopped at or upon the cross
ings of any street or alley within the
limits of the Borough, nor shall any
horse or other beast of draught be tied
or fastened in such a place as to ob
struct the crossing of any street or
alley; and any person who shall violate
the provisions of this section shall he
fined not less than one, nor more than
live dollars, at the discretion of the
Chief Burgess or Justice of the Peace
before whom convicted.
DESTROYING OR MUTILATING SHADE
OR FRUIT TREES.
Sec. 12. Any person or persons who
shall wilfully destroy, mutilate or in
jure any tree planted or growing in
front of any lot or dwelling, or any
other public place or ground within the
limits of the Borough, by cutting or
bruising the hark of such tree or trees,
or by hitching any horse, mule or olhei
beast thereto, or otherwise injure the
same, shall he fined r.ot 1e93 than three,
nor more than ten dollars, for each and
every offense, at the discretion of the
Chief Burgess or Justice of tiie Peace
before whom convicted.
SfC. 13. Any tenant or occupant of
any premises within the said Borough,
who shall knowingly permit any person
to tie or hitch any hoise, mule or other
beast to any shade, fruit or ornament
al tree in front of any premises within
the limits of said Borough, shall be li
able to the same penalty as provided in
section twelve : Provided that the
council may by resolution orner and
regulate the training and trimming of
all trees on the public stieets of the
Borough.
CIRCUS SHOWS AND OTHER EXHIBI
TIONS
Sec. 14. It shall not bo lawful for
any circus show, menagerie, or citeus
and menagerie corabi ed, theatrical ex
hibition, concert, show, mountebank,
juggler, skating rink, or any other ex
hibition, to exhibit, show, play or vend
at any place within the limits of the
Borough, without first having obtained
a license from the Chief Burgess, au
thorizing such circus show, menagerie,
or circus and menagerie combined,
theatrical exhibition, concert, show,
mountebank, juggler, skating rink or
other exhibition, to exhibit, show, play
or vend : Provided that for all concerts
given or held in connection with any
singing class or musical convention no
license fee shall be charged ; And pro
vided finther that no jugglery or game
of chance performance of any kind
shall be permitted on any public street
of the Borough.
Sec. 15. The Chief Burgess is here
by authorized to grant license to any
person or persons, combination of per
sons or company, to exhibit, show.play,
perform or vend within the limits of
the Borough,upon payment to him by the
proprietor or agent, the following sums
respectively for each and every day or
part of a day, viz :
For each circus, menagerie, or circus
and menagerie combined, ten dollars ;
for each exhibition given in small to
medium sized show tents, from three
to five dollats, at the discretion ol the
Chief Burgess ; for each exhibition of
whatsoeyer kind, given in halls or
buildings, tor each concert, excepting
those exempted in section fourteen,and
for each m< untebink sale of medicine,
from one to three dollais, at the discre
tion of the Chief Burgess : Provided
nevertheless that the license fee foi
each skating ri :k or other permanent
exhibition shall not be less than two
dollars for each and every month.
Sec. 10. Any person or persons,
combination of persons or company,
violating the provisions of section four
teen of this ordinance shall be liable to
arrest by the high constable, constable,
or any other officer of the Borough,and
upon conviction of such offensß before
the Chief Burgess or any Justice of the
Peace of the Borough, the offender
shall be fined not less than fiye. nor
more than fifteen dollars, at the discre
tion of the Chief Burgess or Justice of
the Peace before whom convicted :
Provided that in no case shall such fine
be less than the minimum license fee
, for such case made and provided.
A PATER FOR THE HOME CIRCLE.
ST UK NTS AND ALLEYS.
Sec, 17. ll shall he the duty of the
street commissioner, under the direc
tion of the Town Council, to keep the
streets and alleys of the Boorugh in a
pood state of repair,open and free from
obstructions at ail times, excepting as
provided in section eighteen of this or
dinance.
IMJILDINO PERMITS.
Sec. 18. Any person or persons pre
paring to erect or repair any building
within the Borough shall apply to the
cleik of council for a written permit,
and the said clerk is hereby authorized
and required to grant such permit,
giving permission to occupy for a peri
od of six months the one-half of the
width of the street or alley in front or
next to the lot on which such building
is to be erected or repaired, with stone,
brick, lumber, lime, sand and oth
er building material; but sucli building
material shall in no obstruct the
sidewalks or gutters; and if any person
shall put or place any such material on
any street or alley without having tlrst
obtained such permit, or shall occupy
beyond the limits above described, or
shall,after the expiration of six months,
occupy any such street or alley as afore
said, every such person or persons so
offending shall forfeit and pay tne sum
of two dollars for each and every day
the said street or alley shall be thus ob
structed or occupied ; and it shall be
the duty of the street commissioner to
notify him, her or them to remove such
obstructions, and in case of neglect or
refusal to do so within five days after
the service of such notice, the street,
commissioner shall remove the same at
the proper costs and charges of the
owner of such material: Provided how
ever, that after six months have expir
ed the said clerk shall, upon applica
tion. renew such permit for such time
as the Town Council may authorize.
And it shall he the duty of the said
clerk to keep a register of all permits
issued in a book to be kept for that pur
pose, in the margin of which the party
asking the same shall sign an agree
ment to comply with the provisions of
this section ; and the clerk shall charge
for each and every permit so issued a
fee of twenty-five cents,and shtll forth
with pay oyer the same to the Borough
treasurer.
OIISTUCTIONS OX STREETS, ALLEYS OR
SIDEWALKS.
Sec. 19. If any person or persons
shall, on any pretense whatever, ex
cepting as provided in section eighteen,
occupy any part of any street, alley or
sidewalk in the Borough, with wood,
coal, lumber, stone, brick, clay, sand,
brush, ashes, or any other impediment,
obstructions or nuisances of any kind
whatsoever, for a longer period than
twenty-four hours, every person so of
fending shall, upon conviction before
the Chief Burgess or any Justice of the
Peace of the Borough, forfeit and pay a
fine of not less than one. nor more than
three dollars, f..r every such offense, at
the discretion of the Chief Burgess or
Justice of the Peace before whom con
victed, to be collected us other flues
are by law collectable.
Sec. 20. Any person or persons who
shall put or place any manure,compose,
fence, wall,building,impediments or ob
structions in any of the streets, alleys
or public grounds of the said Borough,
or cause the s une to be done, shall for- (
feit and pay a tine of not less than one,
nor more than three dollars, for each
and every such offense,at the discretion
of the Chief Burgess or Justice of the
Peace before whom convicted.
CARCASSES OF DEAD ANIMALS, AC.
Sec. 21. If any person shall put or
place, or cause to be put or placed
within the limits of the Borough, the
carcass of any dead animal, or any part
thereof, or any offal, filth or putrescent
matter whatsoever, every person so of
fending shall upon conviction, forfeit
and pay a flue of not less than two,
nor more than live dollars, at the dis
cretion of the Chief Burgess or Justice
of the Peace before whom convicted
Sec. 22 It shall he the duty of the
high constable, upon complaint being
made to him, or upon his own observa
tion to prohibit and remove any ob
struction in the streets and allevs of
the Borough, and any nuisance or of
fensive matter, whether in the streets,
alleys, public or private grounds, and
to require the removal of the same by
the owner or occupier of such ground,
in default of which the high constable
stiall remove such offensive m itter, or
cause the same to he done, and collect
the costs of such removal with twenty
per cent, added, as piovided in section
four of this ordinance.
DISTURBING TIIK PEACE, LOAFING ON
STREET CORNERS, SIDEWALKS AND
OTHER PUBLIC PLACES,
Sec. 23. Every person or persons
who shall be found in any public street
01 any public place within the limits of
the Borough, making noise and confu
sion, or using profane or obscene lan
guage, or behaving in any other disor
derly manner, or m anywise disturbing
the peace and good order of the Bor
ough, or who shall bo found lounging
upon door steps, cellar doors or other
private property without permission or
against the wish of the owner or occu
pant thereof, or doing injury to public
or private property,or lounging on Street
corners.around lamp-posts,on sidewalks,
or blockading the same, on bridges,
crowding in front or around churches,
embarrassing ingress thereto or egress
therefrom, shall bo liable to arrest by
any police officer, high constable or
constable of the Borough : And it shall
be the duty of every police oflicer, high
constable or constable of the Borough,
to arrest every person or persons so of
fending, and bring him or them before
the Chief Burgess or any Justice of the
Peace of the Borough, and each and
eyery such person shall upon convic
tion, be tined not less than one, nor
more than live dollars for each and ev
ery such offense,at the discietion of the
Chief Burgess or Justice oi the Peace
before whom convicted , and in case of
neglect or refusal to pay such fine, such
person or persons shall be committed
to the lock up of the Borough for a
period not exceeding twent foui hours,
at the discretion of the Chief Burgess
or Justice of the Peace before whom
convicted.
CONTAGIOUS DISEASES.
Sec. 24. That all persons within the
limits of the Borough who may at any
time hereafter he uffiicted witn any
contagious or infectious disease, shall
lie required to confine themselves close
ly and sti ictly their respective
dwellings, until such lime as they can
produce a certificate from some regular
physician, certifying that the person or
persons so a ill icted have so far recover
ed as to go abroad without endangering
the health of the community ; and any
person guilty of violating the provis
ions of this section, upon conviction
before the Chief Burgess or any Jus'ice
of the Peace of the Borough, shall he
fined not lets than live, nor more than
twenty dollars, at the discretion of the
Chief Burgess or Justice of the Peace
before whom convicted.
Sec. 25. All physicians residing or
practicing within the limits of the Bor
ough, who shall treat any cases of con
tagious or infectious diseases, shall re
port the same in writing to the Chief
Burgess immediately after the snme
shall have come to their knowledge ;
and for every neglect or refusal to re
port any such case as herein provided,
such physician shall lie lined not less
than ten, tior more that twenty-five
dollars, at the discretion of the Chief
Burgess or Justice of the Peace before
whom convicted.
DRUNKENESS ON STREETS AND IN
PUBLIC PLACES.
Sec. 2G. Any person or persons who
shall he found intoxicated in any of the
streets, alleys, public houses or public
places within the Borough shall I e fin
ed upon view, or upon proof made be
fore the Chief Burgess or any Justice
of the Peace of the Borough, not less
than one, nor more than three dollars,
for each and every offense, at the dis
cretion of the Chief Burgess or Justice
of the Peace before whom convicted ;
and in case of neglect or refusal to pay
such fine,the offender or offenders shall
be committed to the lock up for a per
iod not exceeding twentv-four hours, at
the discretion of the Chief Burgess or
Justice of the Peace before whom con
cicted ; and the high constable, con
stable of theßorough and all police offi
cers are hereby authorized and required,
upon complaint of any citizen, or upon
their own view, to arrest and prosecute
all offenders against the provision of
this section.
ANIMALS NOT TO RUN AT LARGE.
Sec. 27. It shall not be lawful for
ar.y horses, mules, goats, sheep, swine
or geese to run at large at any time
within the limits of theßorough.nor for
any cows or cattle to run at large as
aforesaid during the hours of night, be
tween 8 o'clock P. M. and 5 o'clock A.
M. : and auv animals so found run
ning at large in violation of the provis
ions of this section shall be immediate
lv seized by the high constable, taken
to the pound and therein confined.
Sec. 28. The high constable shall
have the custody of all animals so ta
ken up and confined by him, and shall
take all needful care of them, and shall
keep a proper register setting forth the
description, time of detention and re
lease. and in case of sale thereof, of the
price received and the name of the pur
chaser. He shall within twenty-four
hours after the seizure and detention of
any animal as aforesaid,no owner having
taken the same away, advertise the
same by posting not less than five print
ed or written notices, one upon or near
the entrance of the pound, and the
others at public places within the Bor
ough, and by one insertion in a news
paper published in the Borough, fully
describing such animal or animals, and
fixing a day and hour not less than
eight days thereafter, for the public
sale thereof.
Sec. 29. In case no owner shall ap
pear ou or before the time fixed for sale,
and pay all legal and proper charges
and costs for the seizure and detention,
keeping and advertising of said animal
or animals, the same shall be sold and
delivered to the purchaser thereof ; and
the said high constable shall first de
duct out of the price received all lawful
charges and costs, and forthwith pay
over the balance to the treasurer of the
Borough : Piovided that the owner or
owners of such animals may at any
time before such sale redeem the same,
bv proving property and paying in ad
dition to other lawful costs and charges
thereon, fifty cents for each aud every
head of horses, mules, cows or cattle,
twentv-five cents for every head of
goats," sheep or swine, and fifteen cents
for every goose so seized and taken.
Sec. 30. Any ptr-on or persons
claiming to be the owner of any animal
or animals taken up and sold according
to the provisions of sections twenty
seven. twenty-eight and twenty nine of
this ndiuance, after such sale, may pre
sent his, her or their claim to the Tow n
Council in session, and it the council
be satisfied of the justice of such claim,
thev shall grant a refunding order on
the treasurer of the Borough in favor
of such claimant, for an amount equal
to that paid into the treasury as the
nett proceeds of such sale : Provided
that no such claim shall be allowed af
ter three months from the date of such
sale-
TAX ON DOGS.
Sec. 31. All dogs and bitches,owned,
kept or harbored by any person or per
sons within the limits of the Borough,
shall be taxed as follows, yiz : one dog,
fifty cents ; each arid every additional
dog, owned, kept or harbored by the
same person, seventy-fiye cents; one
bitch, one dollar ; each and eyery addi
tional bitch owned, kept or harbored
by the same person, two dollars ; to be
collected in liko manner as taxes are
collected for the use of the Borough.
Assessment of all dogs shall be made
by tire high constable, for which he
shall have a compensation of five per
cent.cf the total amount of taxes levied;
and any person or persons denying or
concealing the ownership or harboring
of any dog or bitch, from the high con
stable, shall be taxed twice the rates
aforesaid, foi such denial or conceal
ment.
SELLING MEAT OF DECEASED ANIMALS
Sec. 32. Any person or persons who
will sell or expose to sale within the
limits of the Borough, the flesh of any
deceased animal, or the flesh of any
calf under four weeks old, or other un
wholesome or unmarketable meat, fish,
or provisions, shall upon conviction be
fore the Chief Burgess or any Justice
I of the Peace of the Borough, be fined
not less than five, nor more than twen
ty-fiye dollars, at the discretion of the

DISCHARGING FIIIK ARMS. FIRE
CRACKERS OR SQUIBS.
Sec. 33. Any person or persons who
shall wantonly and withoutany reason
able occasion, lire or cause to be tired,
at any time or place within the built-up
portions of the Borough, any tire arms,
lire-crackers, squibs or other tire works,
shall, upon conviction before the Chief
Burgess or any Justice of the Peace of
the Borough,be lined not less than one,
nor more than live dollars, at the dis
cretion of the Chief Burgess or Justice
of the Peace before whom convicted.
THROWING STONES,MISSILES,OR PLAY
ING AT HALL ON THE PUBLIC
STREETS.
Sec. 34. It shall not be lawful for
any person or persons to cast, throw or
pitch any stone or stones, or other mis
silts of any kind whatsoever, in or up
on any streets or alleys, into any put lie
! or private grounds, or at any building,
vacant or occupied, within the limits
of the Borough ,• and the casting or
throwing of any stones or other missiles
with mischievous, evil, playful or use
less intent, by any person, in or upon
any of the streets or alleys, or at any
b :ildlng, or into any public or private
grounds, is hereby prohibited : Provid
ed that this ordinance shall not apply
to the legitimate handling and use of
stones and other material for proper
purposes, such as building, repairing
streets and similar purposes.
Sec. 35. Any person or persons vio
lating the provisions of section thirty
four of this ordinance shall be liable to
arrest ; and it shall be the duty of the
police, high constable or constable of
the Borough, to arrest every person so
offending, and upon conviction before
the Chief Burgess or any Justice of the
Peace of the Borough, such person or
persons, and each and every of them,
shall be lined not less than one, nor
more than ten dollars, or be committed
to the lock-up for a period not exceed
ing twenty four hours, or both or eith
er, at the discretion of the Chief Bur
gess or Justice of the Peace before
whom convicted.
Sec. 3G. It shall not be lawful for
any person or persons to play at ball in
or upon any of the public streets of the
built-up portions of the Borough ; and
any person or persons, found violating
the provisions of this section shall be
liable to arrest by the police, high con
stable or constable of the Borough, and
upon conyiction shall be lined,each and
every of them, not less than one, nor
more than three dollars, at the dis
cretion of the Chief Burgess or Justice
of the Peace before whom convicted.
FIRES ON STREETS OR PRIVATE
GROUNDS.
Sec. 37. It shall not be lawful for
any person or persons, to build, make
or cause any tire on any of the side
walks, streets or alleys of the built-up
portion of the Borough, at any time or
for any purpose whatever; and any per
son cr persons found violating the pro
visions of this section, upon conviction
before the Chief Burgess or any Justice
of the Peace of the Borough, shall be
fined not less than one, nor more than
five dollars, at the discretion of the
Chief But gess or Justice of the Peace
before whom convicted.
Sec. 38. It shall not be lawful for
any person or persons to build, make or
cause any fire in any yard, garden, or
other private or public grounds within
the built-up portions of the Borough,
excepting for cooking, washing, butch
ering, or other domestic, mechanical or
sanitary purposes ; and any person or
persons found guilty of violating the
provisions of this section, upon convic
tion before the Chief Burgess or any
Justice of the Peace of the Borough,
shall be fined not less than one, nor
more than five dollars, at the discretion
of the Chief Burgess or Justice of the
Peace before whom convicted.
STOVE TIPES NOT TO PASS THROUGH
ROOFS.
bee. 39. Every person or persons
who now occupies, or who shall hereafter
occupy any house, shop or other build
ing within the limits of the Borough,or
the owners thereof, through whose roof
a stoye pipe passes, shall within five
days after notice given nim, her or
them, by the high constable, build a
brick flue from the upper floor in such
house, shop, or other building, to ex
tend at least eighteen inches above such
roof, and shall insert the end of such
stove pipe properly into such flue ; and
every person or persons neglecting or
refusing to build such flue and conduct
such stove pipe therein as aforesaid, af
ter notice, shall for every such neglect
or refusal torfeit and pay a sum of
not less than five, nor more than twen
ty dollars,at the discretion of the Chief
Burgess or Justice of the Peace before
whom convicted.
Sec. 40. It shall be the duty of the
high constable, upon complaint of any
citizen, or upon his own observation,or
upon the direction of the Town Council,
Chief Burgess,orAssistantßurgess,that
if any s'ove pipe or pipes is or are ex
tending above the roof of any building
contrary to the provisions of section
thirty-nine of this ordinance, to give
notice to the owner or occupier of such
building to build a flue as aforesaid,
within live days from such notice, or
else to refrain from using fires in such
building, and if such notice is not com
plied with, to notify the Chief Burgess,
or Assistant Burgess thereof who shall
then impose upon such delinquent a
fine as aforesaid and proceed to collect
the same tor the use of the Borough, as
debts of like amount are now by 'aw re
coverable.
BATHING REGULATED.
Sec. 41. Bathing on Sunday in any
stream, dam or race within the limits
of the Borough,or on any other day be
tween the hours of eight o'clock A. M.
and six o'clock, P. M., is hereby pro
hibited ; and every person or persons
found violating the provisions of this
section shall be lined not less than one,
nor more than three dollars, at the dis
cretion of the Chief Burgess or Justice
of the Peace before whom convicted, or
undergo a confinement in the lock-up
for a period not exceeding ten hours.
Sec. 42. Any person or persons
found guilty of indecent exposure while
bathing, to any other person or persons
than those also engaged in bathing at
the same time and place, shall be fined
not less than one, nor more than three
dollars, at the discretion of the Chief
Burgess or Justice of the Peace before
whom convicted, or undergo a confine
ment in the lock-up for a period not ex
ceeding ten hours.

SLAUGHTER HOUSES.
Sec. 44. It shall not be lawful to
build any slaughter house or butcher
shop, or to use any building already
erected as a slaughter house or butcher
shop, within the limits of the built-up
portions of the Borough ; and any per
son or persons who shall, in violation
of the provisions of this section, haye,
keep or maintain a slaughter house or
butcher shop, upon conviction before
the Chief Burgess or any Justice of the
Peace of the Borough, shall forfeit and
pay a fine of twenty-five dollars : Pro
vided that meat markets, for the sale
of dressed meat,shall not be prohibited
at any place within the Borough.
.LICENSE TO HELL GOODS.
Sec. 45. It shall uot be lawful for
any person or persons who travel from
place to place to sell or expose to sale
any goods, wares or merchandise of any
kind whatsoever whether by auction or
at any fixed place or building within
the limits of the said Borough, without
having first obtained a license from the
Chief Burgess, granting permission to
sell such goods, wares or merchandise :
Ana the Chief Burgess shall grant sucn
license upon application and the pay
ment of a sutn uot less than five, nor
more than twenty dollars, at the dis
cretion of the said Chief Burgess.
Sec, 46. Any person or persons vio
lating the provisions of section forty
five of this ordinance, after notice that
a license is required and a demand for
the license fee, shall be liable to arrest,
and upon conviction before the Chief
Burgess or any Justice of the Peace of
the Borough,be fined not less than ten,
nor more than thirty dollars,at the dis
cretion of the Chief Burgess or Justice
of the Peace before whom convicted, to
be recovered as other fines are by law
recoverable.
Sec. 47. The provisions of sections
forty-five and forty-six of this ordi
nance shall not apply to any person or
persons who shall come into the said
Borough from any other place or places,
for tne purpose of locating and carry
ing on a permanent business, nor to
any person or persons who shall hold a
license granted by the Court of Quarter
Sessions of the county, or by the coun
ty Treasurer.
IIIGn CONSTABLE, CONSTABLE, AND
POLICE.
Sec. 48. It shall be the duty of the
high constable, constable and police of
ficers, upon complaint made to them
or to any one of them, or upon
their own observation or knowl
edge, of any violation of the several
sections of this ordinance, or of any
other ordinance or ordinances of the
Borough,forthwith to prefer complaint
to the Chief Burgess or any Justice of
the Peace of the Borough, or such com
plaint may be made by any person or
persons aggrieyed, and such Chief Bur
gess or Justice of the Peace shall In
stitute legal proceedings against the
alleged offender or offenders,in the cor
porate name of the Borough,and on the
lawful conviction of such offender or
offenders, the forfeiture, penalty or
fine adjudged against him, her or them,
with costs, shall be levied and collected
for the use of the Borough, as forfeit
ures, penalties and fines are by law re.
coyerable ; and the said high oonstable,
constable and police officers shall be
paid such compensation for such ser
vices as may be fixed by the Town
Council.
Sec. 49. In all cases where fines are
imposed under any of the sections or
provisions of this ordinance.or any oth
er ordinance, of the Borough,which are
not paid or secured to ba paid forthwith,
the person or persons against whom
such fines are adjudged shall be commit
ted to thelock-up for a period not ex
ceed ingtwenty-four hours, at the dis
cretion of the Justice of the Peace be
fore whom action is brougnt for the
recovery of such flue or flues.
COMPENSATION OF CHIEF BURGESS.
Sec. 50. The Chief Burgess shall re
ceive a compensation or salarj of ten
dollars per annum for his official sery c
es, payable at the expiration of each
yearly term, which shall be in lieu of all
other compensation and fees in hearing
and determining offenses against the
ordinances of the Borough.
BOROUGH MONIES SHALL BE PAID OVER
TO THE TREASURER.
Sec. 51. All monies received by the
Chief Burgess as license fees, forfeit
ures, penalties, fines and fees in hear
ing and adjudging cases under the or
dinances, and all other monies and
sums received by the Chief Burgess and
other officers of the Boroueh, for the
use of the Borough, shall forthwith oe
paid over to the treasurer of the Bor
ough, whose receipts, stating from
whom received and from what sources
the sums respective'y haye accrued,
shall be sufficient vouchers on the set
tlement of the accounts of such officers.
GENERAL PROVISIONS.
Sec. 52. All actions, prosecutions,
complaints and proceedings for the vio
lation of the ordinances, regulations
and resolutions of the Borough of Mill
heim, and for fines, penalties and for
feitures enacted or imposed thereby,
shall be brought before any Justice ,of
the Peace of the said Borough,and shall
be instituted in the corporate name of
the said Borough, and all such fines,
penalties and forfeitures shall be for the
use of said Borough, and the officer or
officers serving the process or processes
of auy Justice of the Peace of the said
Borough, shall receive such costs or
fees as they are entitled to by the
laws of this commonwealth, and the
same shall be paid by the person or per
sons fined in pursuance of said ordi
nances, as part of the penalty inflicted.
REPEALING SECTION.
Sec. 53. The ordinance containing
thirty-three sections, ordained, enacted
and approved the 20th day of April, A.
D., 1879, shall be, and the same is here
by repealed.
