The Supreme l.'ourt decided, by a bare ma
jorily, that the act paaxtd by the Legislature
April t, 1868, to protect the honest exercise of
the elective franchise, as fur as it applies to
the city of Philadelphia, is unconstitutional
Chief Justice Tbompsou delivered the opinion
of the court which was concurred In by
Judge Sharswood and the conclusion of width
was agreed to by Judge Strang, for the sim
ple reason that the phraseology of the act wai
bad. Judges Agnew and Read delivered dis
senling opinions (which we publish,) ful'y
sustaining thu act, and expressing the bclijf
that It cuuld be carried iuto effective opera
Hon.
The court seems to stand as follows i In
favor of a registry Inw, Judges Thompson,
Strong, Read and Agnew, and against any
such law, Judge Sharswood.
Whether the wise provuionsof this most
wholesome law shall be delayed for another
year depends upon the Executive of tbe State.
It Is for him to say whether the Legislature
shall be re-conveneed and the corrections
made as suggested by tbe Supreme Court of
tbe State.
A stringent registry law, rigidly enforced,
last summer would havo prevented the mur
dor of John Casey, saved the sanctity of the
Roman Caiholln ptv-s'hood from violation in
tha person of Father Tracy, the priest who
paid over tha hi'trnnner, ail avoided to
Pennsylvania tho disgraco of being carried by
disunion party.
