estate for and during her natural life, in four acres on
the east side of the property, surrounding and cen
tered on the existing antenna tower, together with
the use of the existing access road to the antenna
tower, and the right to receive the rental therefrom.
TERMS OF SALE: The successful purchaser is
required to pay a deposit of Ten Thousand Dollars
($10,000.00) in the form of cash, a cashiers or certi
fied check at the time of sale, and will be required to
sign a contract of sale containing the following
terms:
The balance of the purchase price shall be due at set
tlement which shall be held on or before June 30,
1998. The property is sold subject to the life estate
in four acres above described, and in "AS IS" con
dition. Neither the seller nor the auctioneer make
any warranties of the condition of the property,
whether express or implied. The auctioneer selling
the property has no knowledge of any environmen
tal problems affecting the property, but assumes no
responsibility for any such problem that may arise.
Taxes and other public charges shall be adjusted to
the date of settlement. All recordation costs, recor
dation taxes, document preparation fees, title exam
ination fees and title insurance fees shall be borne
by purchaser. The seller herby notifies the purchas
er that the land described in this sales advertisement
is, or may become subject to the tax set forth in the
Annoted Code of Maryland, Tax Property Act. Sec.
13.301 et seq, or successor provisions, providing
generally that land which has been assessed on the
basis of agricultural use may be developed only
upon payment of a transfer tax. Purchaser shall be
sole responsible for such tax. In the event of default
by Purchaser, Seller shall retain the deposit as liqui
dated damages and Purchaser will be released from
further performance.
Seller reserves the right to reject any and all bids,
however it is the intention of the seller to sell.
NOTE: Farmland is currently under lease thru
1998, possession of house and other buildings at
time of settlement.
