by Ciba Crop Protec
tion, have both received
a special local needs la
bel for Pennsylvania for
use on transplanted cab
bage and bell peppers.
These registrations
are sponsored by Ciba
and the Pennsylvania
Vegetable Growers As
sociation (PVGA). In
order to use the herbi
cide on these crops, a
grower must sign a
waiver of liability and
indemnification agree
ment and pay an annual
fee of $5O if he or she is
a PVGA member or
$lOO if a non-member.
The waiver of liabili
ty and indemnification
agreement are required
due to the potential for
crop injury, the high
values of the crops, and
the low potential eco
nomic return to the
manufacturer. Growers
must obtain a copy of
the label, sign the waiv
er of liability and in
demnification agree
ment in presence of a
notary public, and re
turn it to PVGA along
with the payment of the
use fee for approval.
PVGA will then re
turn the approved label
to the grower. It is ille
gal to apply Dual to
these two crops unless a
signed and PVGA ap
proved label is in the
crop owner’s possession
at the time of applica
tion. It is actually neces
sary to sign a separate
waiver of liability and
indemnification agree
ment for each crop (cab
bage and bell peppers)
but only one use fee is
required.
