opportunity to vote on a proposed
amended New York-New Jersey
Federal Milk Marketing Order
(Order No. 2) in a mail referen
dum ending on Dec. 28.
The order as proposed to be
amended, contained in a final deci
sion issued by the U.S. Department
of Agriculture on December 2,
1994, will replace the existing
Class II milk price formula with
the basic formula price for the sec
ond preceding month plus a fixed
differential of 30 cents. The
change was considered at a public
hearing held Jan. 6 and 7.
All dairy farmers Who were
producers under Order No. 2 in
March 1994 will be eligible to
vote on the amended order. Quali
fied cooperative associations of
producers may cast bloc votes on
behalf of their members. A pro
ducer who is not a cooperative
member, or whose cooperative
does not bloc vote, may vote by
individual ballot.
Whether an individual, partner
ship, corporation or other type of
business enterprise or unit, a pro
ducer is entitled to only one vote
regardless of the number of farms
which the producer may operate,
the number of health permits
which may have been issued to the
producer, or the number of plants
to which the producer may have
delivered milk during the repre
sentative period.
Approval of the order as
amended requires a “yes” vote
from at least two-thirds of the
dairy farmers who cast ballots.

Class II price formula in all feder
al milk orders. The Class II price
would be the basic formula price
(Minnesota-Wisconsin price at 3.5
percent butterfat, M-W price) for
the second preceding month plus a
fixed differential of 30 cents.
The announcement date of the
Class II price would be moved up
from the current date, on or before
the 15th of the previous month, to
the same date as the Class I price
announcement in all Federal
orders, on or before the fifth day of
the month.
The announced price would
apply to milk marketed during the
Following month. The “add-back”
provision under existing Class II
pricing will be eliminated.
The proposed revised Class II
formula will improve the efficien
cy of pricing and marketing milk
used in Class II manufactured
products. Movements in the Class I
and Class II prices will be coordi
nated. In addition, month-to
month volatility in the Class II
price often encountered under the
existing formula should be reduced
under the proposed formula.
The changes to Federal Order
No. 2 also are applicable to New
York State Order No. 126 and New
Jersey Order No. 57-3. These con
current state orders are essentially
identical to the Federal order.
The final decision and referen
dum ballots will be placed in the
mail soon. The referendum agent
urges all eligible producers who
are not voting collectively and
who do not receive a ballot to con
