Private applicators (farmers certified to apply restricted use pesticides) will be required to keep records for each application of a general use or a restricted use pesticide. Records must be maintained for two years and must include the name and address of certified applicator; location of treated area; date of application; brand or common name of pesticide applied; application rate and total amount applied; acreage or size of area treated; and crop or site treated. Federal requirements under the Food, Agriculture, Conservation and Trade Act of 1990 (Farm Bill) that became effective May 10, 1993 require private applicators to keep records for each restricted use pesticide application. However, the new state regula tions will preempt the federal requirements and will be enforced by the Maryland Department of Agriculture instead of United States Department of Agriculture. Prenotification by the certified applicator will be required before application of any soil fumigant. Residents within 300 feet of the application must be notified at least 24 hours before the fumigant application occurs. Copies of the revised regula tions can be obtained by contact ing Mary Ellen Setting. Chief, Pesticide Regulation Section, Maryland Department of Agricul ture, SO Harry S. Truman Park way.
