On November 7. 1876, nobody won the presidential elec
tion Although Governor Samuel J Tilden of New York
carried the popular vote with 4,287,670 votes to Ohio
Governor Rutherford B Hayes’s 4,035,924 voles, Tilden was
one electoral vote short of the 185 needed to win To resolve
the dispute. Congress appointed a special electoral commis
sion made up of five senators, five representatives, and five
Supreme Court justices. After nearly four months of deliber
ation and bargaining, the commission awarded all 20 of the
disputed electoral votes to Hayes, giving him the 185 neces
sary to claim victory. On March 3, 1877,
