NOTICE OF AMENDED GENERAL QUARANTINE ORDER OF MARCH 25, 1993
On January 20, 1993, the Commonwealth of Pennsylvania, Department of Agriculture, adopted a General Quarantine
Order due to the presence of HSN2 Avian Influenza pursuant to the authority granted by Section 1702 of the "Administrative
Code", Act of June 7,1923 (P.L. 498, No. 274) (71 P.S. § 442), Section 6of the Act of July 22,1913 (P.L. 928, No. 441), (71
P.S. S 1221) and the Act of April 17,1929 (P.L. 533, No. 236) as amended by the Act of May 10,1974 (P.L. 287, No. 87), 3
P.S. S S 341 et seq.. On February 12,1993, the Commonwealth of Pennsylvania, of Agriculture, adopted an
Order which amended the General Quarantine Order. Further amendment to the General Quarantine Order was
adopted March 25,1993, to require negative Influenza tests to qualify poultry for movement In Pennsylvania. Avian
Influenza is a disease of domestic poultry caused by exposure to Type A Influenza Vims.
Certain additional amendments to the General Quarantine Order are now necessary to ease restrictions of poultry
due to evidence of an abatement of the disease. Surveillance of poultry movements and investigation of influenza
exposed markets during the past six weeks Indicate the risk of HSN2 influenza to poultry has been greatly reduced.
Whereas pre-movement test requirements have impeded the marketing of poultry from small flocks. It is Important to
ease marketing restrictions in line with reduction of Influenza risk. These amendments remove pre-movement lest
requirements for the transportation at poultry and provide additional criteria for release of non-lnfected flocks from
quarantine. The Interstate HSN2 Avian Influenza Quarantine Order of February 12,1993 restricting the importation
o t live poultry has been rescinded effective June 1,1993. These amendments will reduce the cost of Influenza preven
tion but will maintain effective measures to detect and contain HSN2 avian Influenza In domestic poultry.

Rffective Date; The Amended General Quarantine Order contained in Annex A was adopted on June 1, 1993 and was
effective immediately upon adoption. Notice of adoption of the amended quarantine is being provided by publication in full
in Lancaster Farming and Harrisburg Patriot News. In addition, the Department is issuing public announcements and press
releases regarding the imposition of the quarantine and directly notified numerous affected parties.

COMMONWEALTH OF PENNSYLVANIA DEPARTMENT OF AGRICULTURE
AMENDED GENERAL QUARANTINE ORDER
WHEREAS, the Pennsylvania Department of Agriculture has declared and hereby declarer that HSN2 Avian Influenza ir a
direare of a dangeroua traniminible nature;
WHEREAS, the HSN2 Avian Influenza virus porei a serious risk to the integrity of the Pennsylvania poultry industry and
the economy of Ibis Commonwealth;
WHEREAS, the Pennsylvania Department of Agriculture hat broad powers to prevent the spread of infectious and com
municable diseases and to protect the health and well-being of this Commonwealth's animals including poultry;
WHEREAS, the Pennsylvania Department of Agriculture had evidence of HSN2 Avian Influenza in Pennsylvania poultry
and further evidence indicating possible exposure to HSN2 Avian Influenza in poultry entered for show, exhibition or display
and poultry present at animal markets;
WHEREAS, a General Quarantine Order was adopted by the Department of Agriculture on January 20,1993 (23 Pa.B.
S4l) to prevent the introduction and spread of HSN2 Avian Influenza in Pennsylvania poultry;
WHEREAS, the threat of HSN2 Avian Influenza to Pennsylvania poultry has abated;
WHEREAS, the General Quarantine Order of January 20,1993 as amended February 12 and March 25,1993 estab
lished poultry transportation controls that arc no longer necessary to prevent HSN2 Influenza; and
WHEREAS, the Pennsylvania Department of Agriculture is confident that surveillance of key marketing sites and
conveyances of live poultry will be adequate to detect future Introduction of avian Influenza into domestic poultry.
NOW, THEREFORE, THE PENNSYLVANIA DEPARTMENT OF AGRICULTURE, pursuant to the authority granted
by Section 1702 of the “Administrative Code”, Act of June 7,1923 (P.L. 498, No. 274) (71 P.S. § 442), Section 6 of the Act
of July 22,1913 (P.L. 928, No. 441), 71 P.S. § 1221) and the Act of April 17,1929 (P.L. 533, No. 236) as amended by the Act
of May 10,1974 (P.L. 287, No. 87), 3 P.S. § 5 341 et seq. promulgates the following Amended General Quarantine Order for
the prevention, control and eradication of contagious or infectious diseases including HSN2 Avian Influenza.
1. No track and no coop, cage, crate or other conveyance may enter a farm in Pennsylvania for the purpose of removing
eggs or live poultry unless that track and/or the coops, cages, crates or other conveyances are in a sanitary condition. For the
purpose of this Order, sanitary condition shall mean that the track, coop, cage, crate or other conveyance of live poultry has
been cleaned and disinfected prior to its arrival on the farm and that egg packing materials must be new, unused or sanitized
impervious materials. The operator of the track shall maintain a record of the dates of cleaning and disinfection and shall
have in his possession a copy of that record, including receipts for such service if performed commercially.
2. All poultry flocks, premises, or areas located within the Commonwealth known to be infected with, exposed to or suspi
cious of Avian Influenza caused by type A HSN2 virus shall be placed under Special Quarantine or General Quarantine. It
shall be unlawful for any owner or person, without a special permit in writing from an officer or agent of the Department of
Agriculture, to sell, exchange, lease, lend, give away, allow to stray, remove ir iiiuw to be removed, any poultry or any
poultry product, goods, materials, containers, vehicles, cars, conveyances or other articles on property named or described in
an order of quarantine.
A. Permits for interstate movement of poultry, poultry products and any other amcles related to the production, marketing
or disposal of those poultry products from flocks, premises or areas quarantined because of HSN2 Avian Influenza shall
comply with Part 81 of Title 9 of the Code of Federal Regulations and the requirements of the state of destination. Permit may
be issued only by an official representative of the Pennsylvania Department of Agriculture.
B. Permits for interstate movement of poultry, poultry products and other articles related to production, marketing or dis
posal of these poultry products from flocks, premises or areas quarantined because of HSN2 avian influenza may be issued
subject to the following restrictions.
(1) Poultry, poultry products and other articles infected with or contaminated by Type A HSN2 Avian Influenza virus may
be moved only for the purpose of, and only direcdy to an approved site for sanitary disposal. Such movement shall be under
the direct supervision of an official representative of the Department of Agriculture.
(2) Permit may be issued for movement of poultry and poultry products quarantined because of the presence of HSN2
influenza antibody if HSN2 influenza virus is not known to exist m the flock or on the premises.
(a) In the absence of clinical signs of influenza and if vims has not been found by culture of 30 birds in each flock and by
culture of 30 swabs of the environment, permit may be issued to move live poultry direct to slaughter and permit may be
issued for the movement of eggs to an egg processing establishment provided egg containers are sanitized prior to return to a
farm.
(b) Disposal of dead poultry, eggs, refuse, litter and other potentially contaminated articles originating from premises quar
antined because of Avian Influenza antibody shall be only according to instructions issued by the Department of Agriculture.
(c) Vehicles, equipment, coops, crates, cartons and other conveyances of poultry and poultry products and associated
materials from premises quarantined because of Avian Influenza antibody shall be managed so as to prevent spread of Avian
Influenza and shall be cleaned and disinfected prior to engaging in further transportation of any article upon public highways.
C. Special Quarantine of premises and poultry flocks exposed to, suspicious of, or infected with HSN2 Avian Influenza
may be released when;
(1) All HSN2 seropositive and all HSN2 exposed live poultry have been depopulated according to protocol established
and supervised by the Department of Agriculture, all poultiy carcasses and pans thereof, eggs, litter, manure and refuse have
been properly disposed and the premises, building, and equipment cleaned and disinfected and insect and rodent vectors have
been eliminated according to protocol established and supervised by the Department of Agriculture and culture swabs of the
premises, buildings and equipment are HSN2 vims culture negative and no live poultry are taken onto the premises sooner
than 30 days after Department of Agriculture approved cleaning and disinfection has been completed; or
(2) There have been no overt signs of Influenza disease on the premises for at least 45 days, at least 150 randomly
collected tracheal swabs and at least 150 randomly collected environmental swabs from each flock on the premises are
HSN2 virus culture negative on two tests conducted 30 or more days apart and 50 Influenza serologically negative
birds In each flock on the premises remain HSN2 seronegative for at least 30 days after the first set of virus negative
swabs; or
(3) When investigation of a suspect or exposed flock reveals no evidence of HSN2 influenza virus or antibody:
(a) 30 or all birds m each flock whichever is less are HSN2 antibody negative and
(b) 30 or all birds in each flock whichever is less are HSN2 virus negative and
(c) representative environmental swabs are HSN2 virus culture negative.
D. Violation of quarantine may result in imposition of fines, revocation of peimits and forfeiture of any right to indemnity
from the Department of Agriculture for condemned poultry or other articles.
3. Surveillance shall be conducted throughout Pennsylvania to detect the presence of Avian Influenza. It shall be the duty
of the consignor and the consignee of poultry and poultry products originating from Pennsylvania poultry flocks on request to
submit designated specimens of poultry tissues for diagnostic purposes to the Department of Agriculture. It is also the duty of
every person having knowledge of the existence of Avian Influenza in Pennsylvania to report that information to the Depart
ment of Agriculture.
4. This Order is adopted June 1,1993 and is effective immediately and shall remain effective until further order of this
Department.
For purpose of this Amended General Quarantine Order, poultry shall mean chickens, ducks, geese, turkeys, pigeons, chu
kars, guineas, exotic fool and game btsds raised in captivity.
