OF AGRICULTURE NOTICE OF AMENDED GENERAL
QUARANTINE ORDER OF JANUARY 20, 1993
On January 20, 1993, the Commonwealth of Pennsylvania, Depart
ment of Agriculture, adopted a General Quarantine Order due to the
presence of HSN2 Avian Influenza pursuant to the authority granted by
Section 1702 of the "Administrative Code", Act of June 7, 1923 (P.L.
498, No. 274) (71 P.S.§ 442), Section 6 of the Act of July 22, 1913 (P.L.
928, No. 441), (71 P.S. § 1221) and the Act of April 17,1929 (P.L. 533,
No. 236) as amended by the Act of May 10,1974 (P.L. 287, No. 87), 3
P.S. § § 3241 et seq. On February 12,1993, the Commonwealth of Pen
nsylvania, Department of Agriculture, adopted an Order which
amended the General Quarantine Order. Avian Influenza is a disease of
domestic poultry caused by exposure to Type A Influenza Vims.
Certain additional amendments to the General Quarantine Order are
appropriate to facilitate the safe marketing of live poultry within Pen
nsylvania. Wereas, this Quarantine Order has heretofore prohibited the
marketing of live poultry by livestock auctions and certain other city
markets and has prohibited the exhibition of live poultry, these amend
ments will lift the latter ban and will provide test requirements for the
safe marketing of live poultry. These test requirements are the same as
those currently requited for the interstate movement of live poultry to
mid Atlantic and northeastern states. This amendment will provide
relief to owners of poultry who cannot currently market their live birds
because of the previous quarantine constraints and will provide reason
able premovement assurances that the birds are free of HSN2 Avian
Influenza.

Effeirtlve Date
The Amended General Quarantine Order contained in Annex A was
adopted on March 25,1993 and was effective immediately upon adop
tion. Notice of adoption of the amended quarantine it being provided by
publication in full in Lancaster Fanning and Harrisburg Patriot News.
In addition, the Department it issuing public announcements and press
releases regarding the imposition of the quarantine and directly notified
numerous affected parties.

AMENDED GENERAL QUARANTINE ORDER
WHEREAS, the Pennsylvania Department of Agriculture has dec
lared and hereby declares that HSN2 Avian Influence is a disease of a
dangerous transmissible nature;
WHEREAS, the HSN2 Avian Influenza virus poses a serious risk to
the integrity of the Pennsylvania poultry industry and the economy of
this Commonwealth;
WHEREAS, the Pennsylvania Department of Agriculture has broad
powers to prevent the spread of infectious and communicable diseases
and to protect the health and well-being of this Commonwealth's ani
mals including poultry;
WHEREAS, the Pennsylvania Department of Agriculture hat evi
dence of HSN2 Avian Influenza in Pennsylvania poultry and further
evidence indicating possible exposure to HSN2 Avian Influenza in
poultry entered for show, exhibition or display and poultry present at
animal maikets;
WHEREAS, a General Quarantine Order was adopted by the Depart
ment of Agriculture on January 20,1993 (23 Pa.B. S4l) to prevent the
introduction and spread of HSN2 Avian Influenza in Pennsylvania
poultry;

WHEREAS, the threat of HSN2 Avun Influenza to Pennsylvania
pouluy has not abated; and
WHEREAS, the General Quarantine Order of January 20,1993 pro
vides inadequate diagnostic criteria for the release of poultry and poul
try products from HSN2 Avian Influenza special quarantine.
NOW, THEREFORE, THE PENNSYLVANIA DEPARTMENT OF
AGRICULTURE, pursuant to the authority granted by Section 1702 erf
the “Administrative Code", Act of June 7,1923 (P.L. 498, No. 274) (71
P.S. § 442), Section 6 of the Act of July 22. 1913 (P.L. 928, No. 441),
(71 P.S. $ 1221) and the Act of April 17,1929 (P.L. 533, No. 236) as
amended by the Act of May 10,1974 (P.L. 287, No. 87), 3 P.S. 55 341
et seq. promulgates the following Amended General Quarantine Order
for the prevention, control and eradiction of contagious or infectious
diseases including HSN2 Avian Influenza.
1. No live poultry greater than one week of age may be transported
within the Commonwealth of Pennsylvania, except direct to a federally
inspected slaughter establishment, unless the following conditions ate
met;
A. The live poultry originates and moves directly from an Avian
Influenza monitored source as established by the Department; or
B. The live poultry is accompanied by an approved health certificate
certifying that the birds represented thereon originate from a source
flock in which a random sample of ten birds has been blood tested nega
tive for HSN2 Avian Influenza using the agar gel immuno diffusiuon
test and that said tests were conducted within ten days of the date of
movement
2. No truck and no coop, cage, crate or other conveyance may enter a
farm in Pennsylvania for the purpose of removing eggs or live poultry
unless that truck and/or the coops, cages, crates or other conveyances
are in a sanitary condition. For the purpose of this Order, sanitary condi
tion shall mean that the truck, coop, cage, crate or other conveyance of
live poultry has been cleaned and disinfected prior to its arrival on the
farm and that egg packing materials must be new, unused or sanitized
impervious materials. The operator of the truck shall maintain a record
of the dates of cleaning and disinfection and shall have in his possession
a copy of that record, including receipts for such service if performed
commercially.
3. All poultry flocks, premises, or areas located within the Common
wealth known to be infected with, exposed to or suspicious of Avian
Influenza caused by type A HSN2 vims shall be placed under Special
Quarantine or General Quarantine. It shall be unlawful for any owner or
person, without a special petmit in writing from an officer of agent of
the Department of Agriculture, to sell, exchange, lease, lend, give away,
allow to stray, remove or allow to be removed, any poultry or any poul
try product, goods, materials, containers, vehicles, cars, conveyances or
other articles on property named or described in an order of quarantine.
A. Permits for interstate movement of poultry, poultry products and
any other articles related to the production, marketing or disposal of
those poultry products from flocks, premises or areas quarantined
because of HSN2 Avian Influenza shall comply with Part 81 of Title 9
of the Code of Federal Regulations and the requirements of the state of
destination. Permit may be issued only by an official representative of
the Pennsylvania Department of Agriculture.
B. Permits for intrastate movement of poultry, poultry products and
other articles related to production, marketing or disposal of these poul
try products from flocks, premises or areas quarantined because of
HSN2 avian influenza may be issued subject to the following
restrictions.
(1) Poultry, poultry products and other articles infected with or conta
minated by Type A HSN2 Avian Influenza virus may be moved only for
the purpose of, and only directly to an approved site for sanitary dispos
al. Such movement shall be under the direct supervision of an official
representative of the Department of Agriculture.
(2) Petmit may be issued for movement of poultry and poultry pro
ducts quarantined because of the presence of HSN2 influenza antibody

if HSN2 influenza virus is not known to exist in the flock or on the
premises.
(a) In the abense of clinical signs of influenza and if vims has not
been found by culture of 30 birds in each flock and by culture of 30
swabs of the enviroment, permit may be issued to move live poultry
direct to slaughter and permit may be issued for the movement of eggs
to an egg processing establishment provided egg containers are sani
tized prior to return to a farm.
(b) Disposal of dead poultry, eggs, refuse, litter and other potentially
contaminated articles originated from premises quarantined because of
Avian Influenza antibody shall be only according to instructions issued
by the Department of Agriculture.
(c) Vehicles, equipment, coops, crates, cartons and other convey
ances of poultry and poultry products and associated materials from pre
mises quarantined because of Avian Influenza antibody shall be man
aged so as to prevent spread of Avian Influenza and shall be cleaned and
disinfected prior to engaging in further transportation of any article
upon public highways. ,
C. Special Quarantine of premises and poultry flocks exposed to, sus
picious of, or infected with HSN2 Avian Influenza may be released
when:
(1) All live poultry have been depopulated according to protocol
established and supervised by the Department of Agriculture, all poultry
carcasses and parts thereof, eggs, litter, manure and refuse have been
properly disposed and the premises, building, and equipment cleaned
and disinfected and insect and rodent vectors have been eliminated
according to protocol established and supervised by the Department of
Agriculture and culture swabs of the premises, buildings and equipment
are HSN2 Vims culture negative and no live poultry are taken onto the
premises sooner than 30 days after Department of Agriculture approved
cleaning and disinfection has been completed; or
(2) All serologically (HSN2 influenza antiboidy) positive birds have
been removed according to 4.8. (2).(a) and HSN2 vims has not been
found in any of 30 tracheal swabs from each remaining flock and HSN2
virus has not been found in representative environmental swabs and 30
serologically negative birds in each remaining flock remain antibody
and vims culture negative for at least 90 days; or
(3) When investigation reveals no evidence of HSN2 influenza vims
or antibody:
(a) 30 or all birdi in each flock whichever ii leii are HSN2 antibody
negative and
(b) 30 or all biida in each flock whichever it leu are HSN2 virus
negative and
(c) representative environmental swabs are HSN2 virus culture
negative.
D. Violation of quarantine may result in imposition of fines, revoca
tion of permits and forfeiture of any right to indemnity from the Depart
ment of Agriculture for concdemned poultry or other articles.
4. Surveillance shall be conducted throughout Pennsylvania to detect
the presence of Avian Influenza. It shall be the duty of the consignor
and the consignee of poultry and pouultry products originating from
Pennsylvania poultry flocks on request to submit designated specimens
of poultry tissues for diagnostic purposes ot the Department of Agricul
ture. It is also the duty of every person having knowledge of the exis
tence of Avian Influenza in Pennsylvania to report that information to
the Department of Agriculture.
5. This Order is adopted March 25,1993 and is effective immediately
and shall remain effective until further order of this Department.
For purpose of this Amended General Quarantine Order, poultry shall
mean chickens, ducks, geese, turkeys, pigeons, chukars, guineas, exotic
foul and game birds raised in captivity.
