Dear Pennsylvania Pork Producers and Allied Industries,
The Pennsylvania Department of Revenue has issued a ruling declaring
sales tax is due on all types of slotted pig flooring (woven wire, expanded
metal, etc.) used in pig production.
The Pennsylvania Department of Revenue has completed a Pennsylvania
sales tax audit of our company. They have assessed our company with sales
tax and penalty on all flooring sold since January 1, 1985. They have also
requested and received the names and addresses of all customers who have
purchased grating since January 1, 1985, who have farm use tax exempt
certificates on file with our company. These customers will be receiving a
sales tax and penalty assessment.
The Pennsylvania Department of Revenue will be doing a Pennsylvania
sales tax audit on all Pennsylvania companies marketing pig flooring in the
near future to assess sales tax on pig grating sold since January 1,1982.
Our company and other industry representatives feel this is an unfair
ruling and will create an additional production cost for the pig industry. We
feel therefore, this tax assessment of pig grating should hie appealed on a
statewide industry basis. Our company has until June 12,1985 to file a notice
of intent to appeal with appeals board.
Our company is asking the following organizations to assist and fund this
appeal.
PA Farmers Association
Penn Ag Industries
PA Pork Producers Council
A reply from these organizations in the immediate future is requested. A
decision as an industry needs to be made as soon as possible. Without
assistance from the industry, our company does not wish to fund the appeal
and would not appeal the ruling.
Our company is asking you as a producer or allied industry person to
contact these organizations in the next ten days requesting them to support
this appeal effort for the Pennsylvania pig industry.
