The language is part of an agreement included in the pending stopgap'federal fun ding legislation. As previously announced, the loan rules required state governors to certify that at least 25 small businesses in a county must have suffered substantial economic injury before SBA would grant loan approval. The new language states that loan eligibility “shall not in any way be dependent upon the number of disaster victims in any county or any political sub division.” Gary D. Myers, president, The Fertilizer Institute, hailed the congressional action, saying that the earlier rule effectively assured nonqualification for loans, “since rural areas generally have no more than five or six farm input businesses per county.” Myers noted that expansion of SBA’s economic injury loan program was approved by Congress and signed into law by the President in April of this year as a direct result of cooperative industry efforts to lessen the im pact of the PIK program on fer tilizer and other farm supply retailers. The subsequently released rules, he said, had served to negate those efforts. “In 1983, American farmers took 83 million acres out of production to participate in the PIK program. The effect on small farm input businesses such as fertilizer, feed, equipment, and agri chemical dealers was disastrous,” Myers said. “For some, the impact was of such magnitude that their only alter native was to declare bankruptcy.
