Judge Commisa ruled against the Trustee at Mrs. Furman’s request on the Trustee's, “Motion for Summary Judgement.” If this motion had been approved, the Trustee would have had a judgement against the farmers and could have collected the money that they received form the Scheps last July. The Trustee sued to recover this money, which the Scheps paid to farmers after they filed their bankruptcy petition. Judge Commisa’s decision last Thursday does not end the Trustee’s case. It still can go to trial on factual issues. However, according to Mrs. Furman, if the Scheps are allowed to reopen their plant real soon, and if the Trustee bows out or the Court removes the Trustee, these suits will dry up. She said she has the agreement of the Scheps’ attorneys that they will not pressure the Trustee’s suits (even though they legally could do so), and that in court last Thursday the Scheps’ attorneys opposed the Trustee’s suits. Mrs. Furman said that un fortunately this favorable ruling only applies to those farmers she represents, and that the motion for summary judgement against those farmers who have been sued but whom she does not represent will be heard later, with the outcome unknown at this time. The Pennsylvania Farmers Union, the Pennsylvania State Grange and the Northern Tier Milk Producers have been paying the out-of-pocket expenses for Mrs. Furman, who has been donating her time and legal fees in the Scheps case. Chester L. Reed, State Executive Director said today, “This is a small victory for the farmers that Attorney Furman has been representing.” AMERICA ON THE GROW K*lWW*A* I *4* MW FISHER 4109 E.
