said. Under the bill, these
businesses would be required to
label all chemicals in the work
place and provide a training
program for employees about
these substances.
In most cases, chemical con
tainers are already labeled and
provide information on the sub
stances found within. However, if a
container is not labeled correctly,
the businessman or farmer must
correct the labeling, Lee said.
Labeling of containers includes
secondary containers, as well, he
said. For example, if a farmer
purchased a 50-gallon drum of
fertilizer and placed the contents

Under H.B. 1236, farmers and
businessmen would also be
required to supply a list of all
hazardous chemicals in their
workplace if a community
member would request this in
formation, Lee said. The list of
substances would then be recorded
with the state Department of
Health.
Approximately 2,500 “hazar
dous” substances have been listed
by the Department of Health.
The “Right to Know” bill, Lee
said, was drafted with worker
safety in mind, but it must be
reasonable for the employer also.
“We think Pennsylvania needs a
right to know law,” he said, “but it

Pa. Farmer’s Association (PFA);
however, as drafted, H.B. 1236
would create additional paperwork
for fanners and employers.

they are working with and provide

bill goes beyond its beneficial
nature.
“It is our belief that farmers
would have a considerable amount
of paperwork as the bill is writ
ten,” Myers said.
Included in the paperwork,
Myers explained, would be the
filling out of a Material Safety
Data Sheet (MSDS). Developed by
OSHA, the MSDS form should be
