Agent explains oil and gas leases
HONESDALE Recent success
in discovering new oil and gas
reserves in Pennsylvania have
encouraged oil & gas companies to
establish new leases for large
blocks of land for oil & gas ex
ploration according to Joe
Madalek Community, Develop
ment Agent.
Since oil and gas leases may
have a great impact on the land,
the landowner and the community,
Macialek stated, it is important
that all aspects of a lease be
thoroughly understood and agreed
to.
The gas exploration company,
the lessor, generally has a com
mon lease form which is offered to
the landowners, the lessee. The
landowner, however, may choose
to attempt to negotiate change in
any part of the lease or offer a
substitute lease prepared by the
landowner’s attorney.
Some key points for con
sideration in an oil & gas lease
according to Macialek are as
follows.
When a lease is established, an
agreement is reached on how long
the lessee can hold the land prior to
drilling or renewing the lease. This
primary term is often for a 5-year
period.
A bonus payment is made for the
initial year of the lease. An annual
delayed rental fee is due each year
thereafter during the primary
term.
Failure to pay this delayed
rental fee may automatically
cause the lease to expire. Some
leases, however, may continue to ,
be in effect- even though the
delayed rental fee has not been
paid.
If drilling commences, the
primary term expires and delayed
rental fees cease to be paid.
However, the lease is still in effect.
If drilling stops and no oil or gas is
produced, delay rental fees must
begin again to continue to keep the
lease in force. If production of oil
or gas begins, the lease generally
continues to be in effect as long as
the lessee continues to take oil or

evening, September 17 at 8:00 p.m.
in Court Room No. 2, Court House,
Honesdale The meeting is being
sponsored by the Wayne County
Farmers Association in
Andrea Tauraso, 17, of Frederick, Md. holds Linda C.
Baron memorial trophy as winner of the horsemanship class
during senior Western 4-H and pony show in August at the
Maryland State Fair in Timonium. Andrea and her horse,
Dee's Turp Lady, also placed first in one Western per
formance class and second in another.
