If the tract of land to be exposed is larger than 25 acres, the lan downer or developer must submit the E and S Plan to the County Conservation District, which then will issue a permit for the ac tivities. - On tracts of land smaller than 25 acres, an E and S Plan must be developed and Kept at the site. Revegetation of exposed soil was considered when the Pennsylvania Emergency Management Council (PEMC) adopted regulations in January, 1981, banning certain nonessential uses of water in the Delaware River Basin. PEMC regulations allow the use of freshwater for revegetation of exposed soil where an E and S Plan is required. However, only the minimum rate necessary may be used and only when adequate supplies of other water sources are not available.
