livestock at Sioux City Stock
Yards filed a petition to
review USDA’s order on the
grounds that the stockyard
company’s rule was
“unreasonable and
discunmatory.” The order
permits the Sioux City
division of Umon Stockyards
Corp. to require market
agencies to pay an annual
minimum fee equal to
yardage fees calculated on
the handling of 25,000 cattle
and 55,000 hogs.
The rule was initially put
into force by Sioux City m
September, 1977. At a formal
hearing held for petitioners
in April, 1978, a USDA ad
ministrative law judge or
dered Sioux City Stock
Yards not to enforce the
rule. In September, 1979, the
secretary of agriculture,
through the USDA judicial
officer, reversed this
position and dimissed the
petitioners’ complaints.
Smith said. The recent
ruling by the appeals court
upholds this reversal.
