(one of the G.S.F. associated corporations) during the month of Sep tember 1977 has been delayed by a court order, according to Market Ad ministrator Thomas A. Wilson. Wilson stated that com putations had been made of the pro rata amount of the Producer Settlement Fund credit due each of the delivering producers and it was intended that these checks be prepared and mailed out this month. On December 15,1977, the Market Administrator was served with a summons, complaint and temporary restraining order by David P. Michaels, receiver for the G.S.F. Corporation and its associated corporations. These corporations have filed a petition seeking the protection of Chapter XI of the bankruptcy act. The receiver has taken the position that these monies belong to the estate of the bankrupt, and accordingly, the temporary restraining order prohibited the market administrator from paying over this money to the producers. Wilson explained that normally this money would be sent to handlers for distribution to producers; however, the handler had failed to pay its producers and had sought the protection of the bankruptcy act. Therefore, the market administrator was required to distribute these monies to the individual producers involved. This matter is presently scheduled for hearing before the Bankruptcy Court on January 10, 1978. Wilson added that although the total amount of the credit was relatively small when compared with the total unpaid balances due producers from this handler, he will do everything in his power to protect the rights of the affected producers and to expedite the resolution of this issue.
