CFTC seeks
WASHINGTON, D.C. - The
Commodity Futures Trading
Commission is requesting
comment on revisions of the
definition of “bona fide
hedging transactions or
positions” and the
requirements for classifying
positions as bona fide
hedging.
Comment also is sought on
a proposed new regulation
dealing with requirements
for classifying “certain
other positions” as bona fide
hedging.
The Commission seeks
“substantive” public views
on the proposed amend
ments.
The CFTC has had the
issue under the intensive
review for over a year. In
amending the Commodity
Exchange Act in 1974,
Congress directed the
Commission to review the
definition of hedging.
The revisions resulted
from comments at public
hearings early in January,
which indicated that a
broader definition of hedging

KANSAS CITY, Mo. - The
entire livestock marketing
sector “has traditionally
provided the most inviting
hunting preserve” for
government activity, which
has “placed upon the entire
livestock industry a burden
which so far is impossible to
measure” in terms of
volume or value.
The results of this
governmental regulation
“have not been constructive
nor beneficial,” says C. T.
‘Tad’ Sanders, general
manager of the Livestock
Marketing Association.
In spite of the “high risk
characteristics” of livestock
marketing, Sanders calls for
regulatory reform, saying
that the marketing sector is
faced with “one ever present
obstacle which stands in the
path of innovation and

was both necessary and
desirable. The revisions also
take into consideration (1)
the responsibility to
maintain orderly, com
petitive markets, and (2)
that the commercial utility
of futures trading dpends on
the orderly operations of the
markets.
A major change from the
current definition deals with
cross hedges and an
ticipatory hedges. The
Commission proposed to
adopt a provision that
prohibits exemption from
speculative limits for
positions held during the last
five days of the contract
month, except under special
circumstances where the
position has been approved
in advance.
Interested persons will

government.”
He says that regulatory
reform is needed to remove
the burden of “regulatory
strangulation” from all
avenues of livestock mer
chandising. Sanders cited
the work of the Livestock
Laws Reform Commission in
this area. LLRC is an LMA -
