recent federal court ruling.
The State Department of
Human Resources has in
formed the Maryland
Department of Agriculture
that, under terms of a recent
court ruling, they will be
required to:
1. Register all migrant
and seasonal farm workers.
2. Verify all crew leader
registrations.
3. Monitor “day hauls” for
violations. (A day haul is the
daily pick up and return
transportation service of
farm workers to and from
the fields. The practice is
rare in Maryland).
4. Prepare interstate-job
orders. First preference
under law must be given to
so-called “domestic labor”.
If this is not in supply, then
foreign supplemental
workers may be requested.
5. Perform wage rate
studies.
6. Perform random field
checks covering such items
as: wage and hour
provisions, field conditions,
housing conditions, and
discrimination.
7. Set up and act as first
round mediators in a
“complaint resolution
process”.

intention to perform the
additional inspections in the
spirit of cooperation with
farmers and that visits will
be in an open and announced
manner. They also said such
inspections possibly could
head off citations by federal
officials because farmers
would be given a chance to
meet the standards through
a warning process, rather
than being cited during a
crash inspection by a federal
agent.
Many more farm workers
are now covered under
federal minimum wage rate
laws which, effective
January Ist of this year, call
for a $2 per hour wage to be
paid by all employers who
use 500 man days of farm
labor in any calendar
quarter of the preceding
year.
