Most of these complaints,
the P&S Division said, con
cern giade, weight, condition,
shipping instructions, or time
of arrival.
In administering the P&S
Act. C&tMS is called into these
contract disputes to ascertain
whether the P&S Act has been
violated. The new proposal
outlining the P&S Division’s
policy under the Act is in
tended to serve as a guide
to the industry in such mat
ters.
The proposed policy state
ment points out that all
terms of a transaction should
be made clear in the con
tract, whether it is written
or verbal. If there is any
chance of misunderstanding,
a written confirmation should
be exchanged between the
parties.
