Q. a good bit in bills and
am trying to pay them off as fast
as I can. However, the opportun
ity has presented itself for me
to buy the kind of house I
would like at what I think is a
pretty good price. If I buy it,
can my creditors put liens
against it and take it away from
me? Would it help to put it in
my wife’s maiden name?
A. If you buy the house in your
name, your creditors can proceed
to reduce their claims to judg
ments, and such judgments
would then constitute liens
against your house- If such judg
ments remain unsatisfied, your
judgment creditor could issue
execution and sell the property
to satisfy the debt. Nor will it
help you to buy the house in
your wife’s maiden name- As a
matter of fact, if you buy the
house in any name other' 'than
your qwn and'it is proven‘by
(the creditors that that person is
holding title for your benefit,
they could still proceed to attach
your interest in the property. If
you alone are debtor and you
buy the property in your name
and yqur wife’s name, as ten
ants by the entireties, your
creditors will not be able to at
tach, your interest to this prop
erty unless and until your wife
should predecease you. It must
be noted, however, that if such
property is purchased by your
funds at a time when you pre
insolvent and for the purpose of
defrauding your creditors, such
creditors can reach the property
to the extent of your own con
tribution, notwithstendums; the fact
that title Was taken in the name
of husband and wife. In a
situation of this kind you should
consult an attorney for proper
guidance.
Q. If a girl, under age, mar
ries secretly a man much older
than herself and the groom has
a friend go along and sign the
marriage certificate posing as
the girl’s father, can the mar
riage be annulled’ This happen
ed three years ago The husband
left her shortly after and she
does not know where he is since.

A- Where a marriage is con
tracted in the Commonwealth of
Pennsylvania under the circum
stances set forth in the ques
tion, the marriage could not be
annulled unless the minor girl
was under the age of 12 at the
time of the marriage- By statute,
a marriage may be ‘annulled in
Pennsylvania only Where it was
absolutely void when contracted
Our Courts have held that neith
er minority of the parties nor
fraud are grounds for annul
ment

Q- My husband paid a dentist
$6O for an upper plate- It did not
fit and the dentist made a sec
ond denture- This won’t stay in
his mouth. Is there any way we
can get our money back’
A If the dentist has failed to
make the denture in a workman
ship, competent manner and be
cause of its functional defects
the plate is not suitable for the
purpose for which it is intended,
and if the dentist’s failure to
meet this required standard has
not been caused by the patient’s
uncooperative conduct or action,
the patient should be entitled to
a return of his money The facts
should be submitted to an at
torney to determine what action
be taken-
Q We bought a health insur
ance policy in June, 1954, under
standing that all hospital ex
penses would be paid immediate
ly except for certain exceptions
A few months later my husband
was hospitalized for an eye op
eration and the company noti
fied us they would not pay the
claim. We feel the insurance was
misrepresented. What can we
do M. B-
A. One who enters a contract
is bound by its terms If an eye
operation was excepted from the
[terms of your health insurance
policy, you cannot recover on the
policy. Regarding the accusation
of misrepresentation, you should
contact counsel to study all the
facts which led up to the pur
chase of the policy, and the
policy itself.

Q. After we got married my
wife told me she had been mar
ried before but hadn’t got a di
vorce and didn’t need any be
cause she had been away from
her husband for tfive years. I
would like to know how to go
about getting a divorce without
getting her into trouble because
I still love her.
A- You cannot get a “divorce”
as such because in law you have
not been validly married to the
woman with whom you are liv
ing. Since she has never been
divorced from her former hus
band, jhm and she have in fact
contracted a bigamous marriage.
The fact that your “wife” was
separated from her husband for
five years does not free her from
that marriage In your circum
stances, the proper legal pro
ceeding would be to contact a
lawyer to have your marriage to
this woman annulled as being
invalid and void from the be
ginning Following this if your
wife was not at fault in causing
her first husband to desert, she
can get a divorce from him since
all that is necessary under the
law, if he is not m seivice, is a
willful desertion from her for a
period of more than two years
