HIGHACRES COLLEGIAN, NOVEMBER 16, 1972, PAGE SIX With Justice for (ZNS) There are undoubtedly many strange election races in progress around the nation, but probably none of them is any more bizarre than the race for District Attorney in Wichita Falls, Texas. The only name that appears for District Attorney on the ballot in Wichita Falls is that of the current D.A.—a man named Jimmy Phagan. One of Jimmy Phagan's chief claims to fame is the fact that he was the prosecutor in the well-known marijuana case against 18-year-old Don David Crowe. Crowe was a Vietnam Veteran who was charged last year with selling one ounce of marijuana to an undercover policeman. By the time District Attorney Jimmy Phagan was through with him in court, Crowe had been sentenced to 50 YEARS IN PRISON on the pot charge. Si mince that time, lowever, District Attorney Jimmy Phagan has encountered his own legal difficulties. First, a Grand Jury was impaneled in Wichita Falls to investigate an alleged $6200 embezzlement charge against him. According to one member of that jury who asked not to be identified, the majority of jurors wanted to indict Jimmy Phagan. However, says the juror, pressure was put on jury members by people in the Wichita Falls business community, and the jurors changed their minds. When a vote was finally taken, most jurors voted instead to drop the indictment charges. But Jimmy Phagan ran into some legal trouble again. The "Grievance Committee" of the Texas State Bar Association last summer convened a District Court Hearing on his alleged illegal activities and his manner of running public business. In July, despite reported pressure from the Wichita Falls Community, the Grievance Committee voted to recommend that District Attorney Jimmy Phagan be disbarred—or at least suspended—from practicing law in Texas. Their recommendations have been forwarded to the State Bar offices in Austin, Texas, for final action. Such legal actions would normally destroy the political chances of a man running for office—but apparently not in the case of Jimmy Phagan. The reason: virtually nobody in Wichita falls has heard about the We're No. Three (ZNS) Can you name the three nations with the largest military air forces on the face of the Earth? The world's leading air power is the United States. Second, of course, is the Soviet Union. The third largest? Well, it's South Vietnam—which now boasts an air force with more than 2000 planes and Liberty and All disbarment recommendation or the near-indictment of their own District Attorney. There apparently has been a classic, complete newspaper, radio and television news blackout of all of Phagan's activities. The town's only newspaper, the WICHITA FALLS TIMES AND RECORD NEWS, has not carried a single word about the story; nor have the television and radio stations. Suddenly, however, things in Wichita are beginning to liven up a bit: first of all Attorney Ray Gene Smith has entered the District Attorney's race as a write-in candidate —and has already plastered the town with posters. Attorney Smith, ironically, is the same man who attempted to defend Crowe, the Vietnam Veteran, before he was sent to prison for 50 years. And students from Mid-western University in Wichita Falls are launching a protest of their own; a group of students marched this week to the offices of the WICHITA FALLS TIMES and handed out leaflets. These leaflets called for an end (quote) "to the news blackout," and urged citizens to call the Wichita Falls media, and ask them to begin reporting the charges being made against District Attorney Phagan. Ironically , Vietnam Veteran Don Crowe was beaten up badly in a jail fight this week, where he is being held for possessing one ounce of pot. Meanwhile, in the nearby courthouse, District Attorney Jimmy Phagan continues to maintain his office and seems headed toward re-election despite the repeated charges. US bombs drop on hospitals An American physician who has just returned from a trip to North Vietnam has charged that U.S. warplanes have hit 32 of the 36 provincial hospitals in North Vietnam. Doctor George Roth, a specialist in internal medicine, toured North Vietnam's medical facilities with three other doctors last month. Writing for PACIFIC NEWS SERVICE, Dr. Roth said that the 32 hospitals had all been hit by low-flying U.S. planes and rockets since the step-up in bombing began last April. Dr. Roth said he toured a bombed hospital, visited what is called the "War Crimes Museum" and talked to numerous Vietnamese doctors. He said,"lt became apparent to me that the thrust of the air war is against the Vietnamese people." Roth reported seeing evidence of between 12 and 15 different kinds of anti-personnel devices which he says are dropped "in enormous numbers" by U.S. planes. Doctor Roth described these weapons as "unbelievably vicious and deadly"--and charged that their use is prohibited by international law. Roth, said that one of the anti-personnel weapons he saw was an explosive cannister which sprays our 10,000 metal cubes roughly a quarter of an inch in size. Other weapons, he said, used plastic pellets, which cannot be detected with x-rays. Dr. Roth said that pellets which couldn't be found caused massive infections. On Wednesday, November 15, the Sorority sisters are holding a dinner at Holiday Inn. All girls are urged to attend. Dinner begins at 7:30 p.m. On December 4th, the next monthly Monday meeting will be held. Plans for next term's activities will be discussed. As usual, the meeting starts at 7:30 p.m. December 6th is Annual Pancake Day sponsored by the YM-YWCA. The Sorority sisters will be helping out by serving the pancakes.
