Student struck by car on campus

This past Monday, October 2, at
about 10:00 a.m., Behrend student
Jeanne Deforce was struck by a ve
hicle being driven by student Matthew
Zerbe. The accident took place at the
east intersection of Stadium Drive and
the Reed Lot entrance.
Behrend's Police and Safety are still
investigating the accident, but Man
ager of Police Services Mr. Bill
Donahue feels "it was an accident.
Very unfortunate, but it was an acci
dent."
According to Donahue and state
ments made to Police and Safety by
people at the scene, Zerbe was
stopped at the stop sign exiting the
Reed lot. He proceeded to make a left
turn onto Stadium Drive where the

incident took place. Deforce appeared
to be walking south, from the Erie
Hall lot towards the area of the Reed
Building/Erie Hall, when she was
struck.
According to Donahue, no citations
have been given out at this time, but
he also stated that the investigation
isn't 100 percent complete.
After the accident, Police and
Safety appeared at the scene, and De
force was admitted to Saint Vincent's
hospital. Although the accident was
considered to be serious, Deforce's
injuries weren't life threatening, ac
cording to Donahue.
Many student concerns have sur
faced as a result of the accident, deal
ing with students speeding on cam
pus. According to Donahue, "at this
point, the investigation (on the acci
dent) doesn't show that speeding was

a factor." Police and Safety will con
tinue to occasionally monitor the
speed of vehicles on campus. Due to
the number of duties Police and Safety
is required to handle, Donahue real
izes he can't have an officer on duty,
monitoring traffic speeds all the time.
However, he strongly encourages
students to follow the 15 mph speed
limit all over campus. "There are very
few folks that adhere to the 15 mph
speed limit," said Donahue who re
minds students to be responsible when
driving on campus and "relies on driv
ers to use caution as they would any
where else."
Pedestrians are also encouraged to
take caution when crossing the road.
Donahue encourages pedestrians,
"don't make the assumption that cars
are going to stop." By Pennsylvania
law, vehicles are not always required
to yield
Under Title 75 Motor Vehicles
Code, subsection 3542, subsection A,
pedestrians are protected. It states,
when traffic-control signals are not in
operation, the driver of a vehicle shall
yield the right-of-way to a pedestrian
crossing the roadway within any
marked crosswalk or within any un
marked crosswalk at an intersection.
At Behrend, this means that vehicles
are required to yield to pedestrians at
all intersections and crosswalks.
However, under the same law,
Pennsylvania requires an exercise of
care by the pedestrian, which states,
no pedestrian shall suddenly leave a
curb or other place of safety and walk
or run into the path of a vehicle which
is so close as to constitute a hazard.

voters

With the election drawing near,
voter registration at Behrend is in full
swing. Various groups on campus,
such as College Republicans, College
Democrats, Women Today, and the
Beacon have all at various times over

the past month run voter registration
booths to sign up students to vote. But
according to federal laws passed in
1993 and 1998, the college itself
should be making an effort to register
student voters.
In 1993, Congress passed the
National Voter Registration Act,
which is also known as the Motor-
Voter Bill. One of the major
components of the bill requires
colleges and universities to make
voter registration forms available to
students. In 1998, Congress passed
and Clinton signed the Amendments
to the Higher Education Act, changing
the school's role from passively
making voter registration forms
available to students, to actively
trying to register voters. Part of the
bill states, "... all post-secondary
institutions are to make a good faith
effort to distribute voter registration
forms to each degree or certificate
seeking student who attends classes
on campus. The forms, which are
supplied by each state, must be
distributed before the registration cut
off date for every federal and
gubernatorial election, as well as
special elections for federal office" At
most schools the college registrar is
responsible for this "good faith effort"
of registering students to vote.
