Interesting Libel Suit.-(ennetly vs. the
“Dispatch."
In the District -Court, yVerilay morning,
rhocase of James Kennedy cc. J. Heron . Pus
ter and Reese C. Fleeuu, au action for libel,
Wile taken up. Messrs. and Sproul
appeared for plaintiff, and Messrs. Poster and
Swartzwelder for defendeuts.
Mr. Williams opened the ease for plaintiff.
Ilu sailnews pa per editors fro l uently made per
sonal attacks through their columns and that
this sometimes resulted t in encounters upon the
streets. But in this case the plaintiff proposed
to take the legal and peacablo remedy. The
defendants had published a wilful and malicious
libel against plaintiff, and reiterated iL. The
faets would be laid before the jut_ for their con
sideratium 11. then read. the libelous matter,
which is as follows :
-They may therefore lie, defraud their em
ployees by discharging them and buttlitg at law
their claims tar money loaned, maltreat or
phans in their employ, shave notes on the
money entrusted them by churches, and gen
erally perform any inean or dirty acts of which
their nature proves them capable, without any
further notice at our hands than may be oc
.easioifally necessary guard the public fr no
imposition."
This appears in the Dispatch of June ;Id,
1857. On the 4th of June, the following ap
peared in the sane sheet:
"We nowsay the publishers of the C/fronieir,
(and by this we mean John and .lames W.
Kennedy, and not the partner recently "taken
in'' by them) hare lied—but that, as they just IV
re:narked yesterday, "is their vocation." They
have defrauded an employee by discharging
and battling it law his claim for money
loaned ; one of them so abused a lad in their
employ, (an orphan we believe,) as to compel
hint to apply to the Mayor for protection ; they
have shaved notes, at a time when looney en
trusted to one of them was withheld. and a slow
note given tor its payment. They may -hold
us to answer" for these charges, which they have

The articles read were part of a controversy '
between the Chrmliele and Dispatch, which led
to this libel.
. F. E. Plimpton was one of the editors of the
Dispatch at the time of the alleged libel. Do
not recollect of more than one article of the
character being published.
A. Eater was in the employ of J. W. &
J. B. Kennedy two years previous to tine fall of
1855, when he was discharged. I was obliged
to sue them for my wages ; they were paid to
my attorney. Remember of John Kennedy
buying negotiable paper. I held their notefor
money due me, and 1 brought suit on it. Jas.
Kennedy told me it would be paid promptly,
but it •was not met at maturity; 1 did not-re
ceive the money until last fall.
Mr. Foster offered in evidence.the record of
the pistffet Court in the ease above noted.
The >defense was that the money lend h..en

Alexander Robinson was ip time employ of

and said the costs were to be paid by Kennedy;

Mr. Foster now offered to prove that the
plaintiff had a bill of $2B against Prof. Cowper,

brought a bill against him for $lO or $5O, the

Mr. Cowper obliged to pay the balance, and
Mr. James Kennedy charged on the books of

WM. B. Ross testified that a committee of
ladies •of the Associate Reformed Church , of
Manchester had raised a subscription to Meet
the debt of the church. John B. Kennedy
was appointed Treasurer to apply the fund. I
paid him $5O, $25 being my own subscription,
and $3l collected by my wife. Alava days
after I met Mr. Kennedy, and asked him if be
would discount forme a borough of Manches
ter bond;. he made a proposition, which I ac
espted ; the transfer was made, und•ho paid me
the money on the bond it was the same which
I had given him for the church; one' of the
notes was marked •, 1 mentioned the circum
stance, and he said it was the same money;
that he had not yet deposited it.
Soon afterwards-it was noised about that the
church bond had not been lifted, and a com
mittee, of which I was one, called on Mr.
Kennedy for the money ; he fixed a day.for the
payment; when we called, Kennedy was in a
rage; said he was not bound to pay it unlesa
ho was indemnified ; we agreed to indemnify
him; he still refused to pay it, sayhrs ' he would
hand it over to those who had subscribed- the
money. nold him that he had 'obtained $5O
from mo by false representations, and that I
would prosecute him. Subsequently, in. Fe
bruary, 1853, Mr. Kennedy 'promised to. of
iioto discounted, and pay over the Claim.; this
he did not succeed in doing, and a few days
after the matter was finally 'settled by him
giving; his note sit six months,- with tv good en
dorsement, amounting to $00!1,80. The book
shows that the amount acknowledged by Ms.,
Kennedy, its collected by him, was $604,75.
This included a borough bond for $25, which
he handed over as his own subscription, 'nd
that amount did not appear in the note ; in
terest was probably added on the amount col
lected.

the subscription was made on condition that a
certain amount was raised, or that certain re
pairs were made, which had not been done.

cing the evidence in the strongest posible bear

This morning the case of James Prentiss
and David Hineman, accused of manslaughter,
in causing the death of' Peter Black; was re

The time of the Court until noon was occur
pied in the examination of witnesses. No now
features of the caso were developed, the pur
port of the testimony being to show that the
mind of deceased was wandering a few'. days
previous to his death..'

In the afternoon, D. D. Bruce proceeded to
address the jury in behalf of the defendants,
in nn eloquent and able speech •of two hours::
He was followed by District Attorney Cole
liar, who summed up the several points of the
case in a brief address of twenty•mittntes.
Judge M'Cluro now read his charge to The
jury. He defined the various grades of mur
der, and said that although the indictment was
drawn for murder, it was the opinion of all the
judges that the evidence showed that there
should be no conviction for murder, either in
the first or second degree. The jury would
then consider if the evidence was sufficient to
warrant a verdict of manslaughter. If they
were satisfied that the witnesses were compe
tent they should believe them. They mustex
amino if there had been a quarrel and. a strUg,
gle, and if, from injuries received in thatstrug
gle, ono of the parties concerned in it came to
his death—and in so examining it makes no
difference whether deceased or defendant
struck the first blow. If they concluded, be-
yond a reasonable doubt, that such injuries
were inflicted by defendants, then it wa. , their
duty to bring in a verdict iu accordance with
that determination.
At live o'clock the casewas given to the jury
and Court adjourned until nine o'clock.
When the Court met at nine o'clock thejury
came in with a verdict of guilty of manslaugh
ter, as to James Prentiss, with a recommenda
tion to the mercy of the Court, and not guilty
as to David "lineman. A motion in arrest of
judgment and fur a new trial was made.
The Court remanded Mr. Prentiss to jail.
