The Conley Murder Case —^Yester
day, it) the Crurt of Oyer and Terminer; Judges AHisoa
and Ludlow, the case of John Qlalior, charged with the
murdfr of John Conley, was resumed. The following
evidence was elicited :
Thomas Fury sworn,—Hive In Olive street, above Six
teenth ; I was pment when Malloy spoke about -Con
ley; it was in Thoma* CarrblPs taveru, at Twenty
fourth ui;d Spring Garden streeta;. Cooley wai thsre;
Malloy and Conley were talking aod Malloy
cslled him up to driuk, and the bar-feuder asked them
wbat they would take,, and -Malloy callad for gia aad
Conley for sarsaparilla; I was near them, ai £ was
drinking with them; Malloy leaned over the bar and
said to me, “Look at that red—l will killhlm cue
of there daysl did not usk him who be meant; when
be said look, 1 looked at Oouley was the oaly
one who was red; he bad red hair; that wan alt he said;
1 did not ray anything; l looked at him to see if he
nu ant it or not, and Conley laughed, but l don’t know
whether at the remark or hot; don’t kuow whether he
hcaidlt; Malloywßß not laughtug, and he did not look
to very serious; ! can’t say whether he was ia raraest
or je^t; he was leaning over the bar when he said it, and
he did not look at me, but threw his eyes towards the de
ceased.
Cross-examined.—l was examined before the coroner ;
have known Malloy for a jenr and a half; was ia the
tevern about fifteen minutes with Madoy; cau’c say
whether I spoke with biro or not; this took place on Mon
day or Tutsday before the murder ; Malloy bad on a
brownish coat, light pants, and a black Kossuth hat; he
had po wbiskerß.
Jane Callahan sworn.—l live in Biddle street, above
Twenty*third ; remember the night Conley was killed; X
was going an errand; I heard Mr. Conley SHy,>‘ What if
I did say bo?” did not see any fighting; only saw Conley
fall, and that was the lost I saw of him; I saw Conley in
the street all the time; two men were with him; as £ was
coming and was as far as from here to the window,
(about twenty feet,) beard Mr. Conley Bay, *< Whubif I
did t ay *0 7” then £ saw Conley fall;' and that was all £
saw of it; be fell on the street; did not take notice where
the men were when Conley felt; thongut they were only
playing; I did not see where the cues went; I wert up
the street to my aunt’s, and when I heard Mra. Conley
cry I came back ; I think Conley was in the middle of
tbfm when heepeke
Cross-examined.—l think it was moonlight; did not
know any other but Conley ; there were only these three;
I did not pass them ; Conley was lying In the street as I
went on the sidewalk.
. Juba Beg’ey.—l remember the night Conley was
killed; I was standing in \Yillisin street (Twenty-fourth
street,) between Biddle and Spring Garden streets: eaw
’three men; thought they were euow-balliug; they'ware .
cutting up, pulling and hauling; the three <>f them felt
down and got up and ran away; they fe*l on the pave
meat and street both; fell on the street before thoy fell
on the pavement; fell on the pavement last; all got up
aid cema nearer to Spring Garden street; one.of tb«m
wan smoking, and It seemed as if one gave a hox to the
e)h*r and fire.flew; they drew.along and west as far. as
Biddle street; I thought they fell there again ; one of the
men yot up and walked over lo Biddle street; the otber
man stood a few minuies and then walked away too ; the
other man lay after them; be lay there until they took
him away ; Mrs. Conley came, the first woman t aaw.
Cross-examined.—l;W*s on the east side of Twenty- ,
fourth street; I first saw them talking together ; i didn’t
sceany woman passthem; it was a cloudy night.
Saiah Ann Fulmer sworn.—At the time Conley wa?
killed I lived in Little John street, near Brandywine; I
had been out that evening; I had been to Mrs. Nugent,
in Piarl street; I left there .somewhere ahont seven
o’clock; can’t tell you how many squares Mrs. Nugent’s
Is from Twenty-fourth and Biddle; I came out of Pearl

»Btiwl ” tavprn; saw two men : against the step at the
*• Punch BowlJobn Conley passed aroand the corner,
and one of them said “ Good evening ; ,J when he got up
ht twetn,Mulloy said, “Why did you tell that for;”
did rot know the third men; Conley said. “What of It if
-I did tellMalloy said, “ I’ll let you know;” then they
began to lift their handsand then they got across the
street, and Isaw Conley’s cap fall: they bad struck Con
ley several times bt fore he fell; th'ew were not fighting a
great while; it happened at the curbstone, and getbalf
wayecrosß the street, and there they left tbe man lay;
the two men ran down Biddle street; Conley laid there
until his wife came; Conley fell and then got up on his
haucq and blew bis nose and coughed: Mrs Conley went
over with a man and looked at him; 1 heard her s peak;
she took hold of her husband; Conley did not roply to
her; did not see if any of them .were smoking; did not
see any cars knocked off; when Mrs Couiey went to her
hatband I was standing on the corner across the street
from them; bis cap was off then; there was no one about
except Mrs. Conley and a man; she screamed and raised
a'crowd; didn’i fcnow Conley, but I knew Malloy ‘. didn’t
know ihe man who wsb with Malloy; I had teen Malloy
before; he used lo live in Coates street; saw him at the
- Mayor’s cfßce; the prisoner ii the man. -
Cross-examined.—-1 was not examined before the Coro
ner’s inauest; I was examined before the Mayor; Mrs.
Nugent: is a washerwoman ; went on an errand to. see
htr; it did not take long to go from" Pearl street to the
Punchbowl tavern; it took only a few minuter, because
it is not. Jar to go; I knew Malloy a good while in Coates
street—about one year; I knew him by seeifig him;
knew his name; I had net seen him for a goad while
before the night of the murder; he had light clothes on
him then; he had on light Kossuth hat; he had whis
kers; he bad a goatee; he had whiskers just on his chin;
the goatee was middlinglongj l am.suie he had this
goatee; am sure his Kossuth hat was light; it was
moonlight; the door was open whero they were standing!
and the light was shining through the doorway: it
was shining right on him: I think the street lamp was
lighted. - ■
This witness underwent a very long and te3lon3 cross
examination
John Gateley. sworn.—l remember the night Conley
was killed ; I saw him lying in the street; saw his wife
co up to birn u.also went un;.l ricked him up when he
fell, and assisted in cairytng him home: when I'arßir
went up to him, X asked him what was tnemarter; he
cr.uld not speak; bis cap was off; I picked it up and put
it on hfs head; I saw only two men and himself.
OrotS-examined.—l reside corner of Tweaty-fourth
and Biddle streets; the murder took place about twenty
minutes of seven o’clock; I just got there as the meu got
thtre; the whole three were together;'they staid about
three minutes, when they went across the street; a y oung
gchthman passed me: I did not Bee any woman standing
th< re; don’t suppose 1 could see a woman standing in the
.shade near the men, because it was dark and foggy;
there was no moonliebt then; don’t think X could have
tlm crossing; he fell alongside of mo; one of the men had
a black Kossmli hat, long black overcoat and dark pants,

such an order again. We now see that injustice may be
done by the Commonwealth, and injustice might be done
the prisoner; therefore, hereafter he will never make
sneb an order unless there are accommodations made for

The Arrival op Sick and Wound
wounded soldiers who arrived
at Vine.sircet wharf, on Monday, from Fortress Monroe,
were being conveyed in vehicles along Vine street, when
in the neighborhood of Sixth and Tine, alittle girl, abont
ten years of age, coarsely attired, was seen to step out
from the crowd congregated at one of the Corners, and*
approitcbing a carriage, offer to one of .the wounded bol
diersa fan, several of which she carried in her hand.
This act wag repeated until the child’s stock was ex
hausted, when she again stepped up upon the sidewalk,
and there stood until the last carriage had passed the
corner. No one in the crowd appeared to know her, or
what motive, save that of love for the Boldiers, had
prompted so generous an act. She seemed to be entirely
unconscious of the fact that all eyes were upm her, and
neither by word nor look Bought to call forth any word of
approbation from those who were congregated around
