deceased, whether as heirs next of kin. devisees, lega
tees. executors, or otherwise, greeting:
- Whereas, upon nprecipp issued oytfae Register of
Wills of said county to said court, relative to an instru
ment of writing now on file in said court, alleged by tbe
said John Mayberry and George Nyce to oe the last will
and festament of said deceased, but denied so to be by the
slid Michael Gerhart and Catherine, his wife, it was, on
the 9th day of Oetober, A! D. 1658, ordered by said court
that an action npon the case be entered into In said
court, as of August term, 1658, No. 152, by the said
John Mayberry and George Nyce as plaintiffs, and that
the said MlehaeliGerhartand Catherine, his wife, should
'appear as defendants therein, and that tbe case should
be put at issue, and duly proceeded in, so that a trial by
a jury on the merits should be had, to dotermine whe
ther the said instrument is the last will and testament
of said deceased or not, and that the ease should be put
at the head of the trial hat for the second week of No
"yembsvtenni 1858, wbirti term will commence on the
Btb day of November, A. D. 1858; and it was farther
that notice should be given to all persons in
terested, whether as heirs next of kin, devisees, lega
tees, executors, or otherwise, of said action, and to
come into said oourt and become parties to'the same if
they see fit; such notice to be served personally on
each of them as reside in the county of Montgomery, at
least fifteen days prior to the Monday of she second
week of next November term of said court, and to all
others by advertisement once A week during threo
weeks in one daily newspaper published in the city of
